Similar to this, the Constitution (Scheduled Tribes) Order (Fourth Amendment) Bill, 2022 aims to alter the Constitution (Scheduled Tribes) Order, 1950 to include specific communities in Karnataka's Scheduled Tribes list. In addition, the administration will work to pass the Anti-Maritime Piracy Bill, 2019 in the Lower House on Friday. The Lok Sabha first heard about it last week.
With the help of this bill, piracy on high seas is to be specifically suppressed, and it is punishable. The standing committee on social justice's two reports will be presented in the House by BJP MP Rama Devi. The first report is titled "Review of the Functioning of National Institutes Established for Different Types of Disabilities," while the second one is titled "Action Taken Report on the Recommendations Made by the Panel on a Prior Report on the Demands for Grants of the Social Justice Ministry for the Current Fiscal."

Centre seeks Parliament approval for two legislation to include ST communities in state lists

Surendranagar News: The Surendranagar district police on Thursday booked a minor girl, along with her mother, for concealing the birth and death of a baby.

According to sources, the girl was allegedly raped repeatedly by a man in Ahmedabad.

The case came to light when the mother of the girl filed a rape complaint with the police on March 29.

An FIR was filed against the 17-year-old rape survivor and her mother under IPC sections 318 and 114 at a police station in Surendranagar on Tuesday.

The case was registered based on a complaint filed by a deputy superintendent of police (DySP) of Ahmedabad Rural police.

According to the FIR, "The mother, while giving her complaint about the rape of her daughter, didn't disclose that her daughter had also given birth to a baby girl on March 24, 2023, and thus, from the very outset, her intention was to cover up the birth of the baby girl."

The woman had earlier filed a complaint stating that a man repeatedly raped her daughter.

The Ahmedabad police had booked the accused under IPC Section 376(2)(n) for repeatedly raping the minor, under Section 506(2) for threatening the victim, and under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act on March 29. The accused was also booked under the Protection of Children from Sexual Offences (POCSO) Act.

During the investigation, police found that the mother had not disclosed that her daughter had given birth to a child as a result of the repeated rapes. She also did not reveal that the accused had given the minor survivor pills on March 23 to induce an abortion.

The FIR filed at a Surendranagar police station states that the victim gave birth to a baby girl at a primary health centre in Ahmedabad district on March 24.

The victim and her mother then took the newborn to their native village in Surendranagar district, where they buried the baby in a secluded place after she died at around 3 a.m that day.

On learning about the incident, police filed a complaint. For further investigation, the body of the newborn was exhumed on Tuesday after submitting relevant details to the office of the local magistrate.

The mortal remains of the baby were shifted to the Pandit Deendayal Upadhyay Government Hospital, popularly known as Rajkot Civil Hospital, in Rajkot for a forensic post-mortem. IANS

Panaji: In the Goa Legislative Assembly, the Trinamool Congress has demanded for reservations for the Scheduled Tribes community.
Samil Volvoikar, convener of the Trinamool Congress, stated at a press conference in Panaji that his party will take a strong stance in support of the ST community. "In future, if they (community members) stage protest, then also, we will give our support," Volvoikar said.
ST leader Kanta Gawade and Mariano Rodrigues were present on the occasion.
"Since last many years, this issue has been pending. Government should have paid heed to it and given them their right," Volvoikar said, adding it is the constitutional right of ST community to get reservation.
"It is irony that 'adivasi samaj' is deprived of their constitutional right. The ST community has many times demanded for the same through various platforms, but it has only met with injustice," Gawade lamented.
He stated that the ST community of Goa has been asking for reservation in the assembly for the past two decades, but so far their request has been denied despite being a constitutional entitlement.
Kanta Gawade said that the ST community has contributed a lot for the state and that it should be given its right.
He said that the ST community has warned to boycott the Lok Sabha election if its demand is not met. "ST community wants to make the government realise that as they have not been given their right, they will boycott the elections," he said.
All governments over the past two decades, according to Gawade, have failed to grant rights to the ST community. "Right from MLAs to the President of the country, ST community has given memorandum to all. But nobody has paid heed to this issue," he said.
"I appeal to the state and Central government to work in this direction and provide reservation to ST community," he added.—Inputs from Agencies

Pithoragarh: A study has suggested the government to take special efforts including grant of farm lands to empower the particularly vulnerable and dwindling Raji tribe of Uttarakhand which continues to live in near-primitive conditions. A survey conducted by ARPAN – Association for Rural Planning and Action –, an NGO, in collaboration with the South Asian unit of Rosa Luxemburg Stiftung, to understand the social, economic, and political vulnerabilities of the tribe has suggested ways to empower its members so that they can live a secure and dignified life. Raji community also known as “Bot Tho” or “Ban Rawats” live in the remote villages of Pithoragarh, Champawat, and Udham Singh Nagar districts. A total of 249 Raji tribe households spread over 11 villages of the three districts have a total population of only 1,075, it says. “The highest number of Rajis live in nine villages of Dharchula, Kanalichina, and Didihat blocks of Pithoragarh district followed by Champawat and US Nagar districts where one Raji community village each is situated,” Chairperson of ARPAN Renu Thakur told PTI. Thakur suggested strengthening of infrastructure in Raji villages to provide them with complete social security. “The Rajis should be given regular employment to improve their purchasing power. Their existing skills should be enhanced by training and providing infrastructural facilities like irrigation and soil testing,” she said. According to Thakur, almost entire Raji community survives by working as daily wage agricultural labourers, who must be given possession of more land in line with the Forest Tribe Act 2006, so that they can cultivate it and earn a dginified subsistence. The drop out rate among Raji children from secondary schools is 75 per cent due to inaccessibility to schools, their remoteness, and expensive education, the survey report said. “Not only education, health issues of Raji community are also alarming. Raji men suffer from malnutrition and stomach pains while their women folk suffer from reproductive health issues due to early child bearing, frequent pregnancies and lack of proper nutrition,” Thakur said. The survey has been conducted on different parameters including economic status, land holding, education, health, housing and toilets, their access to government schemes and their political status, she said. “Despite being covered under the Forest Rights Act 2006, only 20 per cent of Raji families have government land leases, but even these people have not been given actual possession of the land for farming purposes. Several other claims have been rejected due to lack of sufficient documents,” the survey report said. —PTI

Dehradun: Uttarakhand Chief Minister Pushkar Singh Dhami participated in the fourth National Cultural Festival 2023 of Eklavya Model Residential School organized at Maharana Pratap Sports College, Raipur on Tuesday and said that the festival had become a platform to celebrate the cultural unity in diversity of India. Chief Minister Dhami said, "This four-day event is in line with the spirit of Ek Bharat Shreshtha Bharat while giving impetus to the all-round development of the students pursuing education at EMRS, which will promote continuous cultural engagement, and promote rich India's cultural traditions and heritage. An example of unity in diversity will be created through national integration." He said that this occasion will indeed strengthen the spirit of enthusiasm among the students, cultural connect and also strengthen the sense of national unity among the students coming from different states. The Chief Minister further said, "Mainly five types of tribes reside in Devbhoomi Uttarakhand. Their geographical, economic and historical conditions are almost similar. He himself has spent a significant period of his life among the Tharu tribe." He said that the life of Pandit Nain Singh Rawat of the tribal community also started from this Devbhoomi as a great surveyor, who during his trip to Tibet told the world about the height of Lhasa above sea level by measuring his steps. He also introduced the world to many unseen and unsolved mysteries of Tibet and presented the map of Tibet before the world. The Chief Minister said, "During the last nine years of the tenure of Prime Minister Narendra Modi, there has been integrated socio-economic development of Scheduled Tribes in the country. In this golden period of independence, Prime Minister Modi has given grand recognition to India's tribal traditions and bravery stories. The dream of survival, identity and self-reliance of the tribal society has been realized." The Chief Minister requested Union Tribal Affairs Minister Arjun Munda for the establishment of an additional Eklavya School in the frontier district Pithoragarh. "The state government is giving high priority to the welfare of Scheduled Tribes and improvement in their standard of living. They are being connected to the mainstream of society by their economic, social and educational upliftment and all-round development," he added. The Chief Minister said that four Eklavya Model Residential Schools are running in the state, in Kalsi, Mehravana, Bajpur and Khatima. "Along with the provision of free coaching before competitive exams, monthly scholarships are also being provided to young men and women. A grant of Rs 50 thousand is being provided for the marriage of Scheduled Tribe daughters. The state government has decided to organize the State Tribal Festival and Sports Festival every year for the preservation and promotion of tribal culture. A corpus fund of Rs 1 crore has also been arranged by the state government for the Tribal Research Institute," he added. Students and teachers of Eklavya Model Residential School (EMRS) from 22 states of the country are participating in this program organized by the National Education Society for Tribal Students and the State Eklavya Vidyalaya Organization Committee, Uttarakhand. —ANI

New Delhi [India]: The Supreme Court on Friday issued notice to the Bihar government on the plea challenging a caste-based survey in the state and refused to stay anything arising out of the publication of the data of the caste census. A bench of Justices Sanjiv Khanna and SVN Bhatti made it clear that it is not going to stay anything at this point.
The court said that it cannot stop the state government or any government from taking a decision as that would be wrong. The court, however, said it would consider any issue with regard to data of caste-based survey and examine the issue regarding the power of the state govt to conduct such exercises. The court also sought to know from the Bihar government why they published the data. The court was hearing petitions challenging the Patna High Court's decision to uphold the caste survey initiated by the Bihar Government. The petitioner's lawyer has apprised the court that the Bihar Government has already published the caste survey data, prompting concerns and challenges from various quarters. Among the petitioners are organizations like Ek Soch Ek Prayas and Youth for Equality, who have contested the legality and authority of the caste-based survey. The central government also entered the legal fray, filing an affidavit with the Supreme Court, emphasizing that the Census Act of 1948 bestows exclusive authority upon the Central Government to conduct census-related activities. The affidavit reaffirmed the government's commitment to uplift Scheduled Castes (SCs), Scheduled Tribes (STs), Socially and Educationally Backward Classes (SEBCs), and Other Backward Classes (OBCs) in line with constitutional provisions and applicable laws. One of the petitions, represented by advocate Tanya Shree on behalf of petitioner Akhilesh Kumar, contested the Patna High Court's dismissal of pleas challenging the Nitish Kumar government's decision to conduct the caste-based survey. The High Court's order was issued on August 1. The petitioner had argued that the state of Bihar lacked the constitutional competence to initiate a caste-based survey and usurped the exclusive authority of the Union Government in conducting a census. The petitioner had highlighted that the Bihar government's notification dated June 6, 2022, and the subsequent appointment of a District Magistrate for supervision violate constitutional provisions, including the distribution of powers between the state and the union. The petitioner contended that the entire exercise is without legislative competence and is riddled with malafide intentions. The petitioner underscored that only the Union Government possesses the authority to conduct a census in India, rendering the Bihar State Government's notification null and void. The Patna High Court had previously dismissed similar pleas contesting the caste-based survey ordered by the Nitish Kumar administration. The survey aims to collect data related to people of all castes, sub-castes, and socioeconomic conditions, covering an estimated population of 12.70 crores across 38 districts in Bihar.

Shajapur (MP): Congress leader Rahul Gandhi on Tuesday alleged that social injustice prevailed in every institution in the country, and claimed that members belonging to backward, Dalit and other categories together forming 90 per cent population do not hold any key positions.
Gandhi was addressing a meeting by sitting atop an open jeep in Shajapur in Madhya Pradesh during his Bharat Jodo Nyay Yatra that entered the state on Saturday.  "How much is the population of people from backward classes in this country? It's 50 per cent, then Dalits are 15 per cent, Scheduled Tribes (ST) eight per cent and minority 15 per cent, which comes to about 90 per cent. Now you take out the list of top industrialists and management of top companies, you will not find a single person belonging to this 90 per cent category," he said.
"Similar is the situation in media. You will not find a single big journalist belonging to backward, Dalit or ST categories. It's the same with TV anchors as well as media owners," he claimed.  "Likewise, if you look at bureaucracy, 90 IAS officers at the Centre allocate the entire country's budget. In Madhya Pradesh also, 60-70 IAS officers allocate the state's budget. If you look at the list, you will not find a single person belonging to the 90 per cent category. Even if someone is there, then he must be looking after some minor ministry with a small budget," he said.  So, this is called social injustice and it is happening in every institution, Gandhi added. Similarly, in the list of owners of private hospitals, colleges and universities, not a single person belonging to the 90 per cent category will be found. You will not find a Dalit, Adivasi, person from the minority category in these institutions, he said.
"What is happening in the country is that 3 to 4 per cent people have captured it and no one can enter into that class. On the top, Adani and Ambani are sitting, and 30-40 bureaucrats, IAS officers are there who take all the decisions," he alleged.  The former Congress president alleged that due to paper leak of examinations of government jobs for the posts of Patwari, police and others, the children of poor people suffer a lot while the wards of those belonging to 3-4 per cent category get the exam papers on their phones and prepare only for the five questions mentioned in it.  He also accused the ruling Bharatiya Janata Party (BJP) of making people fight among themselves on the basis of religion, caste and language.  State Congress president Jitu Patwari was present with Gandhi in Shajapur.  Gandhi's yatra later reached Ujjain, where former Madhya Pradesh chief minister Kamal Nath accompanied him to the Mahakaleshwar temple to offer prayers to Lord Shiva. According to Congress sources, Gandhi prayed for the progress of the people of the state and the country.
