Agartala: &nbsp;A 17-year tribal girl was allegedly raped by a man in Tripura's Gomati district, police said on Sunday. Police have arrested the accused and charged him under IPC sections and POCSO Act.The minor girl had come to Amarpur, to attend a village fair at Chandibari temple on Friday evening. "The man offered the girl lift to her home in his two-wheeler. However, on way to home, he forcibly took the girl to a jungle near Chelagang, a remote area of Amarpur sub-division and raped her," Officer in Charge (OC), Birganj police station, Jayanta Das told PTI over telephone on Sunday.The OC said the man left the girl in a jungle and ran away early in the morning. "After receiving the information, a police team rushed to the spot and rescued the girl. Now, the girl is at home and out of danger", he said. The victim's statement was recorded before a judicial magistrate on Sunday, the police officer said.—PTI

Chennai: A 22-year-old youth, who had stabbed a schoolgirl for rejecting his love request, was found dead on a railway track at Tiruchi, Tamil Nadu on Wednesday. Kesavan had stabbed the Class 11 girl near Tiruchi railway station in broad daylight on Tuesday.The girl suffered 14 stab injuries and is battling for life at Tiruchi government medical college hospital. Kesavan was arrested in a Protection of Children Against Sexual Offences (POCSO) case for having kidnapped the same girl in 2021. Police said that Kesavan had just come out of jail after serving prison term in the case.According to Manaparai police that is investigating the case, the accused had proposed to the girl while she was going to a relative's home. When she spurned his request, an infuriated Kesavan stabbed her recklessly. The man fled the spot immediately after the gruesome act. Police were tracing Kesavan from Tuesday onwards and found his body at the railway track near Manaparai, Tiruchi. A case has been registered and an investigation launched.—IANS

Lucknow:&nbsp;The Allahabad High Court's Lucknow bench has granted bail to a man, who is the father of a child born out of wedlock.The man was booked under IPC and POCSO Act offences because the mother of the child is a minor girl.His bail is on the condition that he would take care of the baby and the mother, who is now his wife. The plea on behalf of the applicant said that he loved the girl, who was from his village and the same community. He had eloped with her due to fear of the girl's family members. Later, they married in a temple and they welcomed the child on December 31, 2018.However, the marriage was not legally valid as the girl was a minor.After the girl's father lodged an FIR in Lakhimpur Kheri against the man for kidnapping and raping his daughter, the police arrested him on October 1, 2019.In the course of hearing, the court expressed concerns on the fate of the child."The matter shatters the consciousness of one and all. What is the fault of the newborn baby who has come into the world under such circumstances?" said the bench.Allowing bail plea of the man, the bench fixed the condition that he would look after his wife and the child and also deposit within six months from his release, a fixed amount of Rs 2 lakhs in the name of the new-born child till her attaining the age of majority.The bench further said: "The marriage may not be described as per the law of the land, but the court has to apply a pragmatic approach."—IANS&nbsp;

Hyderabad: Telangana Governor Tamilisai Soundararajan on Sunday ordered the Chief Secretary and the DGP to submit a report within two days in connection with the alleged gangrape of a teenage girl in Hyderabad's Jubilee Hills last week. "Deeply anguished over this heinous incident, the Governor has gone through various media reports on the alleged gang rape case of a 17-year-old girl at Jubilee Hills in Hyderabad. She has ordered the submission of a detailed report within two days on the issue from Chief Secretary and DGP," an official statement by Raj Bhavan said on Sunday. Four accused were arrested in the gang-rape case so far, out of which, three are juveniles. Inspector Jubilee Hills S Rajashekhar Reddy said, "Police arrested fourth accused in the matter. One more accused has been taken into custody, and now a total of four accused have been arrested." The fifth accused is still absconding.A 17-year-old girl was allegedly gangraped when she was returning home after a party in the Jubilee Hills area of Hyderabad on May 28. Following the incident, the minor girl's father submitted a complaint to the police regarding the incident. Following the complaint, a case was registered against five accused involved in the case under sections 354 and 323 of the Indian Penal Code (IPC) and Section 9 read with 10 of the Protection of Children from Sexual Offences (POCSO) Act. The security footage which is viral on social media purportedly showed the girl standing with the suspected attackers outside the pub where she had met them. The boys had offered to drop her home. Instead, she was assaulted inside a parked car in the city. Her attackers took turns to rape her while others stood guard outside the car. Telangana Home Minister Mohammed Mahmood Ali has promised that no leniency is being adopted in the Hyderabad gangrape case while also clarifying that the state police department works without pressure and does not spare the culprits.—ANI

Sharma, while speaking about two minor rape cases in Hyderabad, said, "We took cognizance in the first case where minor was gang-raped in a car by children of political people. The matter is serious because minor girls are being targeted." Mathura: Two youths accused of raping a minor girl, filming the act and sharing it online were arrested here, police said on Wednesday.Two more accused in the case are absconding, they said. An FIR was registered in the case under sections 376 D (gang rape) of the Indian Penal Code, 67 IT Act and under the Protection of Children from Sexual Offences (POCSO) at Jait police station on Tuesday following a complaint by the victim’s father, police said. Deputy Superintendent of Police Praveen Mullick said, “Two accused Pramod and Rahul have been arrested and the hunt for the remaining two is on and they will be nabbed soon.” The incident happened in early June when the four accused lured the 13-year-old girl on the pretext of giving her free firewood and raped her, police said quoting the complainant. The accused also filed the act to further exploit the victim, they said. Two days ago, the accused pressured the girl for the act again and threatened her that they will make the video public. Ghaziabad: A court here has convicted a man of raping a minor seven years ago and sentenced him to 10 years' of rigorous imprisonment. Special Judge of the Protection of Children from Sexual Offences (POCSO) court Sangeeta Kumari also slapped a fine of Rs 70,000 on the convict Shanu Ali and directed him to hand over the amount to the survivor.According to Special Public Prosecutor Sanjiv Bakharwa, the incident took place on July 30, 2015.Ali lured the victim, who was 14 years old at the time, when she had gone for tailoring classes and then raped her, Bakharwa said. Following the incident, the survivor's father had lodged a complaint against Ali at the Tronica city police station. Six witnesses were examined by the prosecution in the case. —PTI

New Delhi: Nudged by the Supreme Court, the Patna High Court has withdrawn the suspension order of a judicial officer, who was penalised for completing a minor's rape trial in a record time of one day.
The high court has also dropped the disciplinary proceedings against the judge.
Shashi Kant Rai, an Additional Sessions Judge from Araria in Bihar, had moved the apex court through advocate Nitin Saluja challenging the suspension order issued by the high court. On August 8, the Supreme Court had asked the Patna High Court to drop all disciplinary proceedings against a suspended additional sessions judge from Bihar for deciding POCSO cases within days.
A bench comprising justices U. U. Lalit and Ravindra Bhat told the counsel representing the high court: "Our sincere advice is to drop everything. If you don't want to, we'll go threadbare into it..". The bench said unless there are allegations of corruption and malafide only then disciplinary action is justified.
Advocate Gaurav Agarwal, representing the high court, submitted that he would inform the high court. "There shouldn't be overzealousness to punish," Justice Bhat had added. Senior advocate Vikas Singh represented Rai in the apex court. Singh said his client was willing to submit a statement to the high court rebutting the charges against him.
The top court orally told the high court's counsel, "He's only following up on his orders, extremely unfair on him...It sends a bad message to others, who are otherwise efficient".
Citing the apex court order on August 8, the high court, in an order passed on August 12, said it will drop departmental proceedings against Rai, special judge POCSO-cum-additional district and sessions judge VI Araria, which was initiated against him on August 5. The high court also recalled the order of suspension issued against him in February this year and the renewal of suspension in August.
On July 29, the top court issued a notice to the registrar general and the state government on the claim by Rai that his suspension order and the pending disciplinary proceedings against him recorded no reasons.
Rai sought to quash the non-speaking suspension order dated February 8, 2022, issued by the Patna High Court and the purported disciplinary proceedings as mentioned therein, being malicious, illegal and arbitrary.&nbsp;

Haridwar / Dehradun: Dr. Visakha Ashok Bhadane, an Indian Police Service officer will be awarded with the 'Union Home Minister's Medal for Excellence in Investigation' by the Union Home Ministry for her role in getting death sentence to the criminal who brutally murdered a girl after raping her.
On December 20, 2020, a girl was raped and murdered in Rishikul Mohalla of Haridwar district and IPS officer Dr. Visakha Ashok Bhadane, who was posted as Assistant Superintendent of Police, Nagar Haridwar, investigated the case.
She arrested Ram Tirath, the main accused in this case on the same day and sent him to jail.
The body of the missing girl was recovered from the second floor of the accused house. During interrogation, he confessed that he, along with one of his friends Rajiv, had raped the girl and killed her and kept the body hidden on the second floor.
Various samples of the deceased were collected and samples of Ram Tirath too were collected and sent to the forensic science laboratory.
On December 26, 2020, the accused brother, Gambhir Chand alias Gaurav was arrested under section 212 of the Indian Penal Code(IPC) for helping the accused Rajiv Kumar.
After that, the police arrested Rajiv also within two days from Uttar Pradesh's Sultanpur On the basis of the evidence collected by Dr Vishakha Ashok Bhadane and the witnesses presented, the Special Judge of the Court, POCSO District Haridwar booked the accused Ram Tirath under sections 363/366A/376(A)(B)/377/302/201 IPC and POCSO.
Ram Tirath was given the death penalty and a fine under the Act while Rajiv Kumar was sentenced to 5 years imprisonment and a fine for hiding evidence.
The Uttarakhand Police informed that the Ministry of Home Affairs, Government of India has announced to confer the 'Union Home Minister's Medal for Excellence in Investigation' to Dr. Visakha Ashok Bhadane for her excellent deliberation. Bengaluru: The Karnataka High Court has quashed a case lodged under the provision of the Prevention of Children from Sexual Offences Act (POCSO) and upheld the marriage between the accused and the victim.&nbsp;
The bench observed on Tuesday that the incident had taken place when the victim was 17 years. However, she married the accused after turning 18.&nbsp;
The couple also had a baby out of wedlock.
The bench headed by Justice Nagaprasanna opined that prosecution won’t be able to prove charges against the accused. In case of the victim turning hostile, the accused will come clean out of all charges and the case will not go to logical end.
The bench refused to accept the arguments of the prosecution against the accused.
The court stated that it is appropriate to end the case as there is consensus between parties. The accused and victim are married and have a baby.
It is not judicious to separate them from married life at this juncture, the bench added.
In 2019, the victim’s father had lodged a missing case.
During investigation, the victim was found with the accused.
In spite of girl pleading that she had willingly gone with the accused, her family had lodged a case of rape.
Since the girl was a minor, the police had lodged a POCSO case against him.
After serving 18-months of imprisonment he was granted bail. The accused and victim married in November 2020.&nbsp;

Pratapgarh: A POCSO court in Uttar Pradesh's Pratapgarh district completed a trial in ten days by convicting the accused in a rape case and awarding life sentence to him. The court of additional district judge (POCSO Act), Pankaj Kumar Srivastava, on Thursday, pronounced life sentence for Bhupendra and imposed a penalty of Rs 20,000. Pratapgarh Superintendent of Police Satpal Antil, who led the probe in the case, said that the minor girl was raped under Kotwali police station area on August 13. "We immediately formed teams, and based on surveillance, arrested Bhupendra. On the day of crime, the forensic team was called without wasting time and it was ensured that all vital evidence was preserved and then within a set time frame, the results were conducted by the lab," said Antil. The forensic investigation confirmed rape of the girl. Later, the chargesheet was filed on September 3 under the charges of rape, kidnapping, abduction or inducing woman to compel her marriage along with the Protection of Children from Sexual Offences Act, 2012, said the officer. The court began the trial of the case on September 12. "We got a witness examination of all the eight conducted. On September 17, Bhupendra was produced in the court," said the SP. The court framed the charges against him on September 21 and announced the judgment on Thursday. Public prosecutor Devesh Chandra Tripathi said that on September 17, when the accused appeared for his statements to be recorded, he claimed to be a minor and placed the educational certificate before the court. "But during the investigation, that certificate was found to be a forged document," he said.&nbsp;

Lucknow: A teacher of a prominent school in Lucknow has been booked under the POCSO Act and detained after a Class 6 girl student accused him of touching her inappropriately during an exam.
The school has terminated the services of the teacher.
According to the FIR, the girl complained to her parents about the indecent behaviour of the mathematics teacher during the exam. Her parents then approached the school administration.
The parents were called to the school on September 26 and were told that the teacher will also remain present.
However, the accused teacher took leave on the day the girl's parents reached the school. The parents then lodged a case with the police.
"My daughter complained about the incident to her class teacher and later to co-ordinator of the school, but there was no response," her mother alleged.
She said the school administration initially tried to hush up the case.
She also accused the teacher of indulging in similar acts in the past with other girls.
Deputy Commissioner of Police (DCP), East, Prachi Singh, said that the accused was booked under section of sexual harassment and Protection of Children from Sexual Offences Act, 2012. He was detained from Aliganj.
"We have taken the statements of the girl before the magistrate and it will be put up with the charge sheet against the accused," she said.&nbsp;

Farrukhabad (UP)(The hawk): According to police, the school principal was arrested on the accusation of a class 9 girl student in Nawabganj, Uttar Pradesh's Farrukhabad district, under the POCSO Act and other sections of the IPC.
The girl had accused the manager-turned-principal of shutting her in a room and chopping her hair off.
The student and her family also met with Additional District Magistrate (ADM) Subhash Chandra Prajapati and lodged a complaint.
If the accused is not held accountable, the girl has threatened to terminate her life.
The student said that the accused had previously hacked off the hair of other girls.
The accused, according to the complaint, made it essential for all the girls to make two braids, but when she only did one, the principal hacked off her hair.
According to Merapur police station Inspector Digvijay Singh, a case has been registered against the accused principal, Sumit Yadav, based on the accusation, under IPC sections 354-A (unwelcome and explicit sexual overtures) and 342 (wrongful detention), as well as the provisions of the POCSO Act.
"Efforts are being made to apprehend the accused principal," he added.

UP principal charged with cutting girl student's hair

Lucknow: A 15-year-old girl was raped inside the high-security Lohia Park here by a man whom she befriended on a social networking site Instagram.
The girl, a student of class 7, has been admitted to Jhalkari Bai hospital after her condition deteriorated. The accused, Vidya Sagar Kushwaha, 20, was arrested from Kanpur , late on Tuesday night.
Police have registered an FIR and are waiting for the survivor to mentally stabilise to be able record her statement.
The police traced his location using electronic surveillance. He works in a textile factory in Gujarat while his family lives in Kanpur. In the FIR lodged with the Gomti Nagar police station, the victim's father said that his daughter met the accused on a social networking site and became friends.
The man called her and asked her to meet him at Lohia Park.
"When my daughter reached the park, the accused took her to an isolated place, raped her and left her in a critical state. She somehow managed to reach home and was sitting in a corner in a state of shock, when her mother enquired about the reason. She narrated her ordeal and the mother found out that she was bleeding," he added.
The family then informed the police and took the girl to the Civil Hospital from where she was referred to the Jhalkari Bai hospital. The family also provided the phone number to the police, from which the accused had called up the survivor. Deputy Commissioner of Police, East Zone, Prachi Singh said an FIR under the charges of rape and the Protection of Children from Sexual Offences (POCSO) Act has been lodged.
She said, "The girl's father is a cart puller while her mother works as domestic help. The teenage girl left home to meet the accused without informing her parents about it."
Chief Medical Superintendent, Jhalkari Bai Hospital, Ranjana Khare said that the minor is under observation. "Her physical condition has stabilised, but she is still in a state of mental shock," she said.
This is the third case of rape in the state capital in the past three days.
Earlier on Saturday night, a 16-year-old school girl was raped by two persons, including an auto-rickshaw driver. On Monday, police arrested the 21-year-old auto-rickshaw driver, Aakash Tiwari. The co-accused is still at large.
On Sunday, a 52-year-old woman filed a complaint alleging that three staff members of an ashram raped her on October 4 under the influence of a narcotic substance. Investigation into the case is underway. —IANS

New Delhi: The Uttarakhand government has told the Supreme Court that the state Cabinet has taken a policy decision to bring areas, presently policed by the Revenue Police, within the jurisdiction of the regular police in a phased manner.
Deputy Advocate General State of Uttarakhand Jatinder Kumar Sethi has told the Supreme Court that the State Cabinet in its meeting held on October 12, 2022, has deliberated upon a proposal for bringing those areas that are presently being policed by the Revenue Police in the State within jurisdiction of the regular police.
The Uttrakhand Government told that in the first phase, all heinous crimes including crimes against women, kidnapping, cyber-crime, POCSO etc shall be handed over to the Regular Police by the District Magistrates immediately and State Administration shall prepare a detailed blueprint for remaining areas and prepare the necessary proposal for up gradation of Cadre Strength of the existing police, necessary Infrastructure for Police Stations and outposts etc along with cost implications and means of financing thereof, which shall be put up for decision of the State Cabinet six months hence.
"In the interim, the District Magistrates shall continue to keep a close watch on crime reported in their respective districts and each case will be assessed for the necessity of handling by regular police and decisions taken accordingly by the District Magistrate on a case to case basis," the state govt has submitted.
A bench of Chief Justice of India UU Lalit and Bela M Trivedi has taken on record the note of the statement regarding the Cabinet decision that has been placed before it.
"Though the issues raised in the Special Leave Petition do call for authoritative pronouncement, in view of the decision taken by the State Cabinet in its meeting on October 12, principally accepting the decision of the High Court and taking appropriate steps to implement said directions, we see no reason to interfere with the present petition. The Special Leave petition is therefore disposed of leaving all questions of law open," the court said in its October 17's order.
An intervention application has been filed in the Supreme Court seeking the abolition of a century-old practice of the Revenue Police System in Uttarakhand in wake of the Ankita Bhandari murder case.
The intervention application was filed by Uttrakhand journalist Anu Pant through advocates Rituparn Uniyal, Abhishek Kumar, Deeksha Saggi and Nayan Mishra.
The intervention application has been filed seeking the abolition of a century-old practice of the Revenue Police System in many parts of the state of Uttarakhand wherein the handling of crime and offences by the Revenue Police has resulted in a law-and-order situation.
The fresh application was filed in wake of the recent murder of 19-year-old girl Ankita Bhandari near Chilla Canal in Rishikesh, Yamkeshwar Block, District Pauri Garhwal. "19-year-old Ankita Bhandari had a month ago joined as a receptionist in Vanantra Resort situated at Chilla Road near Rishikesh and went missing on September 18 from the resort. Her father, who was not able to contact and locate his daughter, came to Rishikesh in search of his daughter but that poor man was made to run from pillar to post by the police and revenue authorities," the application said. —ANI

Bengaluru (The Hawk): The Protection of Children from Sexual Offenses (POCSO) and IPC Acts, according to the Karnataka High Court, are substantive and take precedence over private laws.
The statement was made recently by a bench led by Justice Rajendra Badamikar while reviewing the bail application of a 19-year-old Chikkamagaluru rape suspect.
The accused forced a 16-year-old girl into a lodge after luring her there.
The court ruled that POCSO and IPC statutes are superior and supersede personal laws, disregarding claims that the Mohammedan law defines the typical puberty age at 15 years and that this age also counts as the legal marriage age.
Additionally, it was contended that the POCSO legislation had no jurisdiction over the accused because he is a Muslim.
The bench stated that the petitioner cannot be granted bail in the name of personal law.
Even though a charge sheet had been filed in the case, the court denied the bail because there was a potential that the evidence might have been tampered with.
In another instance, the same bench rejected the justifications for granting release under Islamic law and instead granted bail to the accused on the basis of humanitarian concerns.
After discovering his pregnant 17-year-old wife, the man was arrested under the POCSO Act. The husband's attorney argued that the POCSO allegations against him should be withdrawn because he was married in accordance with Mohammedan law.
Even though the bench disagreed with the rationale, it granted him bail since the accused spouse could care for the minor girl who was pregnant.
