Mumbai: Maharashtra minister Nawab Malik, arrested by the ED in a money laundering case, was admitted to hospital on Monday after he complained of fever and diarrhoea, his lawyer told a special court here and claimed that Malik’s health had deteriorated and he was in a “serious” condition.Last week, Malik (62), who was lodged in the Arthur Road jail here, had sought interim bail on medical ground from the special court for trial of criminal cases against MPs and MLAs.When the matter came up for hearing on Monday, Malik’s lawyer Kushal Mor told the court that when the NCP leader’s family members went to give him home food, they were told that he was shifted to the state-run J J Hospital. Mor also told the court that Malik was ill since the last three days and that his condition has deteriorated and is “serious”. The lawyer prayed that Malik be shifted to a private hospital, saying that several medical test facilities are not available at the J J Hospital. Special judge R N Rokade expressed concern over the prison authorities not informing the court about Malik’s condition and that he was taken to hospital. The judge sought a report from the hospital and posted the matter for hearing on May 5. Malik had sought interim bail for six weeks on medical grounds, citing multiple illnesses, including kidney ailments and swelling in legs. The minister was arrested on February 23 by the Enforcement Directorate (ED) in connection with a money laundering probe linked to the activities of fugitive gangster Dawood Ibrahim and his aides, under provisions of the Prevention of Money Laundering Act (PMLA). He is currently in judicial custody.The ED’s case is based on an FIR filed recently by the National Investigation Agency (NIA) against Dawood Ibrahim and others.The NIA had filed its criminal complaint under sections of the stringent Unlawful Activities Prevention Act (UAPA).The ED had recently filed an over 5,000-page charge sheet in the case against Malik. The NCP leader had denied all charges levelled against him and moved the Supreme Court against an order of the Bombay HC, which had rejected his interim application seeking immediate release from jail. The Supreme Court had also refused to grant him any relief, noting the probe into the case is at a nascent stage.—PTI

Mumbai: A witness in a money-laundering case against Maharashtra minister Nawab Malik has stated before the Enforcement Directorate that fugitive gangster Dawood Ibrahim is based in Pakistan's Karachi city, while another witness said he was told that Dawood would send Rs 10 lakh to his siblings every month. The statements of the two witnesses are part of the charge-sheet filed by the ED against Malik in the money-laundering case pertaining to a property of Dawood Ibrahim. In his statement before the probe agency, Alishah Parkar, son of the gangster's sister Haseena Parkar, said Dawood Ibrahim is his "mamu" (maternal uncle) and used to reside on the 4th floor of Dambarwala Building (Mumbai) around 1986. "After 1986, I heard from various sources and family that Dawood Ibrahim is in Karachi, Pakistan. I was not born when Dawood Ibrahim moved to Karachi, and I or my family members are not in touch with him," he told the ED.Alishah Parkar further stated that occasionally during Eid, Diwali and other festive occasions, Dawood Ibrahim's wife "is in touch" with his wife and sisters.Another witness, Khalid Usman Shaikh, has stated before the ED that "(Iqbal) Kaskar (Dawood Ibrahim's brother) told me that Dawood would send money through his men.""He (Kaskar) said he too would get Rs 10 lakh every month. On a couple of occasions, he showed me wads of cash and said he'd received the money from Dawoodbhai,” the witness told the ED.Malik (62), a senior Nationalist Congress Party leader, was arrested by the ED on February 23 this year in the money-laundering case and is currently in jail.The ED's case is based on an FIR filed recently by the National Investigation Agency against Ibrahim, a designated global terrorist and a key accused in the 1993 Mumbai serial bomb blasts, and his aides under the Unlawful Activities (Prevention) Act.—PTI

Mumbai: Enforcement Directorate in its chargesheet said that both the sons and wife of Maharashtra minister and Nationalist Congress Party leader Nawab Malik were summoned for interrogation, but none of them appeared in connection with Malik's money laundering case. 'Nawab Malik's wife Mehjabin was summoned twice whereas his son Faraj Malik was summoned 5 times in connection with a money laundering case. But none of them appeared before the ED,' informed the chargesheet today morning. According to the ED investigation against him in connection with a money laundering case, 'it was revealed that Malik has had links with fugitive gangster Dawood Ibrahim's D-company for a long time'.The ED has filed a prosecution complaint (chargesheet) before the Special PMLA court in Mumbai.In the prosecution complaint, the ED elaborately mentioned Malik's alleged link to the D-company, and purported conspiracy to 'usurp' the Goawala building compound in Kurla West in 1996.Also, a special court on May 20 took cognisance of the ED's chargesheet against the NCP leader and said there is prima facie evidence to indicate Malik was directly and knowingly involved in the money laundering and criminal conspiracy with others to usurp Goawala compound in Kurla.The court has issued a process against him and the 1993 bomb blast case accused Sardar Shahwali Khan, who is also named in the case.—ANI

Mumbai: The Bombay high court on Friday rejected Maharashtra minister and Nationalist Congress Party leader Nawab Malik's petition seeking release from jail in Mumbai to enable him to cast his vote in the Rajya Sabha elections, polling for which is underway.&nbsp;Malik had sought that he be either released from custody on a bond or be permitted to go with a police escort to the Vidhan Bhavan for voting. A single bench presided over by Justice P D Naik said that although Malik had avoided the use of the word 'bail', the tenor of his plea was that of seeking bail and therefore, he must file an appeal challenging the special court that denied him temporary bail on Thursday. The high court said it didn't wish to set a wrong precedent by entertaining Malik's plea, and permitted the minister's counsel Amit Desai to amend the plea and seek appropriate relief.Malik had mentioned his plea seeking urgent hearing in the HC after a special court on Thursday rejected his plea seeking that he either be released on temporary bail for a day or that he be permitted to go with an escort to cast his vote.He then moved the high court seeking he either be released on a bond or surety just for casting his vote, or he be accompanied by a police escort.On Friday, Desai said that Malik was giving up his prayer for even the surety or bond and just pressing for escort to exercise his "constitutional right" and uphold "democratic principles."Additional Solicitor General Anil Singh, who appeared for the Enforcement Directorate, opposed Malik's plea saying it was not maintainable.Justice Naik said, "From the tenor of the petition, the minister is here is for releasing him from prison. A bond can only be a bail bond under section 439 of the CrPC.""He should have moved an application before an appropriate court," HC said.Voting for six Rajya Sabha seats in Maharashtra began at 9 am at the state legislature complex. Blow for MVA as Bombay HC rejects Nawab Malik's bail plea

Mumbai: If a local court in Mumbai allows former Maharashtra home minister Anil Deshmukh and minister Nawab Malik to cast their votes in the June 10 Rajya Sabha elections, the two leaders will be brought to the Vidhan Bhavan, the state legislature complex in Mumbai, at a specific time to take part in the voting process, an official said on Wednesday. Also, senior Bharatiya Janata Party leader Devendra Fadnavis, who tested Covid-19 positive a couple days ago, will have to cast his vote towards the end of the voting procedure if he continues to remain infected, he said. Deshmukh and Malik, both Nationalist Congress Party leaders who are currently lodged in jail in connection with different money laundering cases, had sought temporary bail from a special court last week to vote in the RS polls. However, the Enforcement Directorate had on Tuesday opposed their bail pleas, citing that they don't have the right to vote under the Representation of the People Act.&nbsp;A special court in Mumbai on Wednesday reserved the order on one-day bail pleas of&nbsp;Deshmukh and Malik to allow them to cast their vote in the elections to the Upper House of Parliament. Voting for the six Rajya Sabha seats from Maharashtra will take place between 9 am and 4 pm. The ruling Shiv Sena has fielded two candidates, its Maha Vikas Aghadi allies NCP and Congress have nominated one candidate each, while the opposition BJP has put up three candidates. The contest for the sixth seat lies between BJP's Dhananjay Mahadik and Shiv Sena's Sanjay Pawar.The 288-member Maharashtra legislative assembly is the electoral college for the Rajya Sabha election, where seven candidates are in fray. If Deshmukh and Malik are not allowed to vote, the number of votes will come down to 285 as there is already one vacancy due to the death of Shiv Sena MLA Ramesh Latke recently.An official of the state legislature secretariat said if Deshmukh and Malik are allowed to vote, they will be brought from the prison at a specific time.In the past, when senior NCP leader Chhagan Bhujbal, who is currently the food and civil supplies minister, was in jail on money laundering charges, he was brought to Vidhan Bhavan to cast his vote for the presidential election in 2017.The special court had allowed Bhujbal to vote when he approached it seeking its directive to let him vote citing that it was his constitutional right as a member of the state assembly.The then jail superintendent and Mumbai police commissioner were asked to take appropriate steps for producing him at the place of polling with sufficient police escort. After casting his vote he shall immediately be taken back to the jail, the court order had stated.Meanwhile, when asked how Leader of Opposition in the assembly Devendra Fadnavis, who has tested positive for Covid-19, would vote, the official said Covid-19 positive people will be asked to cast their vote after all other voters have exercised their franchise.In 2020, a Congress MLA in Madhya Pradesh was among the last leaders to come to cast his vote for the Rajya Sabha election after all other MLAs had voted. The infected legislator had exercised his franchise wearing a PPE kit.An aide of Fadnavis said the former chief minister was tested in the evening of June 4 and his report came the next day, which said he has tested positive for the second time. Since then, he has been in home isolation."Fadnavis is likely to be tested again before June 10. Malik, who is still a cabinet minister in the state, and former Maharashtra home minister Anil Deshmukh, both of whom are in prison after being arrested in separate money laundering and corruption cases, had then sought the court's permission to be let out of custody 'for a few hours', and 'under escort protection' to vote. The high court had rejected the pleas of the leaders, saying that while their lawyers argued that their clients must be permitted to vote to uphold democratic principles, the concept of democracy 'transcended electoral democracy'.The embargo in law, imposed via section 62 (5) of the Representation of the People Act, was based on reason, the high court had said, adding that it has been imposed to ensure 'purity of electoral process and probity of the participants therein'.The two leaders had moved the court earlier contending that as they are members of the Legislative Assembly and representatives of their respective constituencies, they ought to be given the opportunity to vote in the Council election. 'The claim to the exercise of this constitutional right can, by no stretch of the imagination, be said to be absolute,' the high court had said in the judgment.Earlier, Malik and Deshmukh had moved the courts for temporary bail for voting in the June 10 Rajya Sabha election from Maharashtra but were denied relief.

Lakhimpur Kheri: The "errant" tiger, which had killed five people in less than 40 days and was captured three days ago, was shifted to the Nawab Wajid Ali Shah Zoo in Lucknow, an official said on Saturday.The tiger had developed physical deformities due to which it could not hunt its natural prey in the wild and was thus forced to attack humans as easy prey, the official said, adding it was deemed unfit to be released into the forests. "The errant tigress, which was found to be responsible for the recent human casualties in Manjhra Purab forest area, was shifted to Lucknow zoo on Friday night under the supervision of a veterinary expert," Akash Badhawan, divisional forest officer (DFO) of Katarniaghat Wildlife Sanctuary, told PTI. "The tigress reached the zoo on Saturday morning safe and sound," he added.It was captured from the Manjhra Purab forest area of Dudhwa buffer zone on June 29 night. Sanjay Kumar Pathak, field director of Dudhwa Tiger Reserve, told PTI that the shifting was carried out at night as big cats are nocturnal animals."The captured tigress is estimated to be around nine years old and has developed physical deformities. "Her left canines were found broken and worn out, ncapacitating her from hunting her natural prey species in the wild and forcing her to attack upon humans as easy prey," he said.Mr Pathak also informed PTI that during its observation in captivity at Katarniaghat, the experts found it unfit to be released back into the forests. Farrukhabad (UP)(The hawk): According to police, the school principal was arrested on the accusation of a class 9 girl student in Nawabganj, Uttar Pradesh's Farrukhabad district, under the POCSO Act and other sections of the IPC.
The girl had accused the manager-turned-principal of shutting her in a room and chopping her hair off.
The student and her family also met with Additional District Magistrate (ADM) Subhash Chandra Prajapati and lodged a complaint.
If the accused is not held accountable, the girl has threatened to terminate her life.
The student said that the accused had previously hacked off the hair of other girls.
The accused, according to the complaint, made it essential for all the girls to make two braids, but when she only did one, the principal hacked off her hair.
According to Merapur police station Inspector Digvijay Singh, a case has been registered against the accused principal, Sumit Yadav, based on the accusation, under IPC sections 354-A (unwelcome and explicit sexual overtures) and 342 (wrongful detention), as well as the provisions of the POCSO Act.
"Efforts are being made to apprehend the accused principal," he added.
