Colombo: The Indian High Commission in Sri Lanka on Tuesday refuted as 'fake and blatantly false' local social media speculation that former prime minister Mahinda Rajapaksa and his family members have fled to India, a day after the patriarch of the powerful Rajapaksa family quit as premier amidst the unprecedented anti-government protests.'The High Commission has recently noticed rumours circulating in sections of media and social media that certain political persons and their families have fled to India. These are fake and blatantly false reports, devoid of any truth or substance. The High Commission strongly denies them,' a statement said.The whereabouts of Mahinda Rajapaksa is being speculated since his resignation on Monday.It was reported that Mahinda left his office-cum-official residence, Temple Trees, early this morning.In its first reaction to the situation in Sri Lanka, India on Tuesday said that it is 'fully supportive' of the island nation's democracy, stability and economic recovery."India will always be guided by the best interests of the people of Sri Lanka expressed through democratic processes," External Affairs Ministry spokesperson Arindam Bagchi said in New Delhi.Meanwhile, Sri Lanka's top civil aviation official on Tuesday rejected social media speculation and asserted that he was not involved in the 'illegal transport and removal of any person or persons from Sri Lanka'.Captain Themiya Abeywickrama, Director General and CEO of the Civil Aviation Authority of Sri Lanka, in a statement, described the social media reports as 'false allegations'.He asserted that he was not 'linked with the illegal transport and removal of any person or persons from Sri Lanka'.He also made it clear that he had not threatened any licence holder/pilot by interfering in the legal performance of their flying duties.Mahinda, 76, resigned as prime minister amid unprecedented economic turmoil in the country, hours after his supporters attacked anti-government protesters, prompting authorities to impose a nationwide curfew and deploy Army troops in the capital.The attack triggered widespread violence against pro-Rajapaksa politicians.A group of protesters gathered around the Naval base in the eastern port district of Trincomalee, claiming Mahinda had taken refuge there.Calls for his arrest are increasing for his alleged instigation of a mob which went on to attack anti-government protesters who are calling for the Rajapaksa family, including President Gotabaya Rajapaksa, to resign.At least 8 people have died while over 250 people have been injured in the clashes which also saw scores of properties belonging to ruling party politicians being set on fire.President Gotabaya has urged the people to stop 'violence and acts of revenge' against fellow citizens and vowed to address the political and economic crisis facing the nation Sri Lanka is facing its worst economic crisis since gaining independence from Britain in 1948.The crisis is caused in part by a lack of foreign currency, which has meant that the country cannot afford to pay for imports of staple foods and fuel, leading to acute shortages and very high prices.Thousands of demonstrators have hit the streets across Sri Lanka since April 9.—PTI

Brussels: Germany will oppose European Union plans to include nuclear energy as a sustainable investment in its "taxonomy" policy for labelling green investments, the government said on Monday.Brussels is seeking approval from EU countries and European Parliament for its plan to label gas and nuclear as climate-friendly investments, which has split opinion among states who disagree on the fuels' green credentials. Germany, the EU's biggest economy, is among those planning to reject it when countries come to vote on the plan in the coming weeks. "The Federal Government has expressed its opposition to the taxonomy rules on nuclear power. This 'no' is an important political signal that makes clear: Nuclear energy is not sustainable and should therefore not be part of the taxonomy," Germany's environment ministry and its economy and climate ministry said in a statement. "Accordingly, the Federal Government would vote for the Council to object to the EU Commission's delegated legal act," the ministries said.To reject the rules, 20 of the EU's 27 countries must oppose it - a high threshold seen as unlikely to be reached. Germany's stance could also steer opinion in the European Parliament, however, where a majority of the assembly's 705 lawmakers could block the gas and nuclear rules in a July vote. The EU's sustainable finance taxonomy was designed to provide a "gold standard" for green investing, by limiting which investments can be labelled climate-friendly to only those that truly protect the planet. Nuclear energy generation is CO2-free, but produces radioactive waste. Separately, Austria and Luxembourg have threatened legal action over the plan to label nuclear investments as green. The plan to label gas as climate-friendly has faced criticism from countries including Spain, although some countries had lobbied hard for the taxonomy to incentivise gas investments to help them phase out coal. External Affairs Ministry Spokesperson Arindam Bagchi categorically rejected the resolution and asked Islamabad to stop cross-border terrorism and shut down its "infrastructure of terrorism". "We categorically reject the farcical resolution passed by the National Assembly of Pakistan on the subject of the delimitation exercise in the Indian Union Territory of Jammu and Kashmir," he said."Pakistan has no locus standi to pronounce on or interfere in matters that are internal to India, including the Indian territories under Pakistan's illegal and forcible occupation," Bagchi added. The spokesperson was responding to media queries regarding the resolution passed by the Pakistan National Assembly."It is regrettable that instead of putting their own house in order, the leadership in Pakistan continues to interfere in India's internal affairs and engage in baseless and provocative anti-India propaganda," he said. Bagchi said the entire territory of the union territories of Jammu and Kashmir and Ladakh "have been, is and shall always remain an integral part of India." "The delimitation exercise in the Union Territory of Jammu and Kashmir is a democratic exercise based on principles of extensive stakeholder consultation and participation," he said. Bagchi asked Pakistan to refrain from effecting any further material changes in the status of Pakistan occupied Jammu, Kashmir and Ladakh (PoJKL) and vacate the Indian territories that are under its "illegal and forcible occupation". "We reiterate that Pakistan must immediately cease anti-India cross-border terrorism and shut down its infrastructure of terrorism; stop the grave and persistent human rights violations in Pakistan occupied Jammu, Kashmir and Ladakh; refrain from effecting any further material changes in the status of PoJKL, and vacate Indian territories that are under its illegal and forcible occupation," Bagchi said.—PTI

'We have noted the release of the US State Department 2021 Report on International Religious Freedom, and ill-informed comments by senior US officials,' Bagchi said. 'It is unfortunate that vote bank politics is being practised in international relations.'We would urge that assessments based on motivated inputs and biased views be avoided,' he added.Bagchi was responding to media queries on the report.'As a naturally pluralistic society, India values religious freedom and human rights.'In our discussions with the US, we have regularly highlighted issues of concern there, including racially and ethnically motivated attacks, hate crimes and gun violence,' he said.The India section of the report mentioned incidents of attacks on the religious minorities'Attacks on members of religious minority communities, including killings, assaults, and intimidation, occurred throughout the year.'These included incidents of cow vigilantism against non-Hindus based on allegations of cow slaughter or trade in beef,' said the India section of the report.—PTI

New Delhi: The Supreme Court on Wednesday rejected an appeal against the Delhi High Court order dismissing a plea challenging the final answer keys of the Delhi Judicial Service Preliminary Exam 2022.A vacation bench of Justices M R Shah and Aniruddha Bose dismissed the plea saying that the High Court has considered each and every question in detail.Prepare for the next exam. High Court has considered in detail all answers and issues, the bench said.Having heard the counsel for parties and having gone through the impugned order and considering the fact that the High Court has considered in detail each and every question and the answer and have negatived the challenge, we see no reason to interfere while exercising our powers under Article 136, the bench said.The appeal filed by Ananya Tyagi and others had contended that certain questions did not have appropriate answers and therefore the evaluation of the answer sheets was flawed.The High Court had said the petitioners had full opportunity to submit their objections and indeed, had done so.The objections were duly considered by sufficiently qualified persons before the answer key was published and there is no allegation of any malice or lack of bona fide, the high court had said.—PTI

Ahmedabad: A sessions court in Ahmedabad on Tuesday rejected an anticipatory bail application filed by Mumbai-based filmmaker Avinash Das in a case where he is accused of sharing photos on social media to tarnish the image of Union Home Minister Amit Shah and insulting the national flag. Additional sessions judge DD Thakkar rejected Das's pre-arrest bail plea in connection with an FIR lodged against him by the city cyber crime branch in May. Das had allegedly shared a picture on Instagram on March 17, and another on Twitter on May 8. The photo shared on Twitter purportedly showed Union minister Shah with the arrested IAS officer Puja Singhal.The crime branch claimed that it was done with the intention to create misunderstanding among people and tarnish Shah's image.A First Information Report was registered against Das under IPC Section 469 (forgery) and also under the Prevention of Insults to National Honour Act and Information Technology Act.Rejecting Das's plea, the court observed that it appeared that Shah's photo was shared with the intention of defaming him and tarnishing his image, and it clearly suggested "mens rea" (intention/knowledge of wrongdoing).Sharing a photo of a woman with the tricolour showed "mental perverseness," it said.Being a filmmaker, it was the prime duty of the applicant to maintain the dignity of the country and give respect to the national flag as well as the Union home minister, the court added.Das's lawyer argued that Shah's photo with Singhal was taken from a web link and circulated by others and not his client.As to the photo of a woman wearing tricolour, he argued that it was not obscene as claimed.No case was made out under section 469 of IPC for forgery, the lawyer argued further.Opposing the plea, the public prosecutor said the accused was issued three notices so far and a notice was also served to his wife, but he did not cooperate with the investigation. The Bombay high court had recently rejected Das's transit anticipatory bail plea.Singhal, the Jharkhand mining secretary, was recently arrested by the Enforcement Directorate in a money laundering case.Das had directed the 2017 film&nbsp;Anaarkali Of Aarah&nbsp;starring Swara Bhaskar, Sanjay Mishra and Pankaj Tripathi.—PTI

Mumbai: The Bombay high court on Friday rejected Maharashtra minister and Nationalist Congress Party leader Nawab Malik's petition seeking release from jail in Mumbai to enable him to cast his vote in the Rajya Sabha elections, polling for which is underway.&nbsp;Malik had sought that he be either released from custody on a bond or be permitted to go with a police escort to the Vidhan Bhavan for voting. A single bench presided over by Justice P D Naik said that although Malik had avoided the use of the word 'bail', the tenor of his plea was that of seeking bail and therefore, he must file an appeal challenging the special court that denied him temporary bail on Thursday. The high court said it didn't wish to set a wrong precedent by entertaining Malik's plea, and permitted the minister's counsel Amit Desai to amend the plea and seek appropriate relief.Malik had mentioned his plea seeking urgent hearing in the HC after a special court on Thursday rejected his plea seeking that he either be released on temporary bail for a day or that he be permitted to go with an escort to cast his vote.He then moved the high court seeking he either be released on a bond or surety just for casting his vote, or he be accompanied by a police escort.On Friday, Desai said that Malik was giving up his prayer for even the surety or bond and just pressing for escort to exercise his "constitutional right" and uphold "democratic principles."Additional Solicitor General Anil Singh, who appeared for the Enforcement Directorate, opposed Malik's plea saying it was not maintainable.Justice Naik said, "From the tenor of the petition, the minister is here is for releasing him from prison. A bond can only be a bail bond under section 439 of the CrPC.""He should have moved an application before an appropriate court," HC said.Voting for six Rajya Sabha seats in Maharashtra began at 9 am at the state legislature complex. In this election, every vote is crucial for the Shiv Sena-led Maha Vikas Aghadi (MVA), of which the NCP is a constituent, to get the Shiv Sena's second candidate -- Sanjay Pawar -- elected.—PTI

Thiruvananthapuram: The Kerala high court on Thursday dismissed the anticipatory bail plea moved by Swapna Suresh, a key accused in the sensational gold smuggling in the diplomatic bags case, and co-accused Sarith PS, saying the offences she has been booked for in the conspiracy FIR were bailable and he was not even an accused in the case. Suresh and Sarith had moved a joint plea seeking protection from arrest in the case lodged by the police on the complaint of a ruling Left Democratic Front MLA's complaint alleging conspiracy behind her revelations against him, the chief minister and his family. In his complaint, Left MLA and former minister KT Jaleel alleged conspiracy behind the fresh allegations levelled against him, Chief Minister Pinarayi Vijayan and his family by the key accused in the gold smuggling case.The police, thereafter, lodged a case under Sections 153 (giving provocation with intent to cause a riot) and 120B (criminal conspiracy) of the Indian Penal Code against Swapna. Justice Viju Abraham dismissed the anticipatory bail plea saying the offences were bailable and Sarith was not even an accused in the case.Meanwhile, state police chief Anil Kant has constituted a 12-member special investigation team headed by crime branch SP S Madhusoodanan and has directed it to expedite the probe in the case and file a report fortnightly.Besides the Crime Branch SP, the SIT comprises of one ACP, 9 DySPs and one inspector, officials sources said.The sources also said that the probe would be conducted under the supervision of Crime Branch ADGP Shaik Darvesh Saheb.In their joint plea, Suresh said that while the offences were bailable and Sarith was not accused, she believes that CM Vijayan was out to get them in custody to allegedly coerce her into withdrawing her statement made under Section 164 of the Criminal Procedure Code.Suresh had told the media on Wednesday that she only disclosed before the court -- in her statement under Section 164 of CrPC -- the other people allegedly involved in the smuggling cases and their "degrees of involvement".She had said she gave the statement as there were threats to her life and if something happened to her or her family members, she may not have the courage to come forward and speak about the case.In the plea, Suresh also alleged that a person named Shaji Kiran came to her office at Palakkad to settle the issue created as a result of her Section 164 statement.The petition claimed that Kiran was introduced to Suresh by M Sivasankar, former principal secretary to the chief minister, in the past as a person very close to the CM and other Left leaders.It also said that he pressured Suresh and Sarith to surrender before the CM and to give a statement that what she deposed before court was at the instigation of her lawyers, RSS and BJP.He also allegedly threatened them with dire consequences if they do not do as he has instructed, the petition had further claimed.Hours after the plea was filed in the high court, Shaji Kiran had come on a TV channel and claimed that Suresh was his friend and he did not pressurise her to withdraw the 164 statement.Kiran had claimed that he was called to her office by Suresh on Wednesday and while there he had only asked why she made the revelations now and whether she was aware of the problems she would have to face as a result of the same.He had also categorically denied having been sent there to settle the issue and said even Suresh might not know such things have been stated in her plea.In the anticipatory bail plea, Swapna Suresh has said that her 10-year-old son is alone at her residence in Palakkad and therefore, if she is arrested and taken into custody for questioning, there would be no one to look after him."So it is highly necessary in the interest of justice to see that the petitioners are not illegally arrested and taken into custody in the name of questioning as the intention is merely to harass them and coerce them to withdraw the statement given by the 1st petitioner (Suresh) under Section 164 of CrPC," the plea said.After her revelations before the media, subsequent to recording her Section 164 statement, Vijayan had issued a statement dismissing Suresh's claims and allegations as "baseless".Suresh, a former employee of the UAE consulate in Kerala, was taken into custody by the National Investigation Agency along with another accused Sandeep Nair from Bengaluru on July 11, 2020.The NIA, Enforcement Directorate, and Customs conducted separate probes into the racket that was busted with the seizure of gold worth Rs 15 crore from the diplomatic baggage of the UAE consulate at Thiruvananthapuram airport on July 5, 2020.Several people, including M Sivasankar and another ex-employee of the UAE consulate in Kerala, Sarith, were arrested in connection with the case.—PTI

The counting was scheduled to start at 5 pm Friday, but it could not be taken up as the Bharatiya Janata Party approached the Election Commission alleging violation of rules by three MLAs of the state's ruling alliance of Maha Vikas Aghadi.The poll panel directed the Rajya Sabha election returning officer of Maharashtra to reject the vote cast by Shiv Sena legislator Suhas Kande. "The EC took almost eight hours to decide the validity of the votes which were objected upon,"&nbsp;Nationalist Congress Party state president and election in-charge Jayant Patil said. "The process has started after a wait of eight hours,"&nbsp;said the state minister."Voting was over by 4 pm. We had a zoom call with the ECI officials but it took so long to start the counting of the voting. Now, the counting has commenced," he said."One should understand how the system works that takes such a long time to decide on the validity of votes. I hope Shiv Sena MLA Suhas Kande will try to secure his vote legally," he said.Patil and urban development minister Eknath Shinde expressed confidence that despite a vote being declared invalid, all four MVA candidates would be victorious.Patil told reporters that Kande would seek legal recourse, while Shinde said, "We have faith in the legal system."Housing minister Jitendra Awhad, who was given a clean chit by the EC, slammed the BJP for holding Maharashtra to ransom for eight hours.Women and child development minister Yashomati Thakur said, "The truth has prevailed. Chhatrapati Shivaji has taught us how to tackle conspiracies. A befitting reply will be given at an appropriate time."Objections were raised against the votes cast by the NCP's Jitendra Awhad, Congress' Yashomati Thakur and Shiv Sena's Suhas Kande as well as against the BJP's Sudhir Mungantiwar and independent MLA Ravi Rana.Except Kande's, all other votes were ruled to be valid.Kande did not show his ballot to anyone else but still his vote has been invalidated, Patil said.Objecting to the EC's decision, Shiv Sena spokesperson Manisha Kayande on Saturday sought to know the reason behind rejection of Kande's vote.'Rajya Sabha Election: What is the reason behind disqualification of Suhas Kande? Kolkata:&nbsp;A single-judge bench of the Calcutta High Court on Monday rejected the bail plea of 13 persons accused in the violence that took place in West Bengal's South 24 Parganas district after the 2021 Assembly polls.Justice Debangsu Basak said that since the CBI is interrogating the matter, the granting of bail to the 13 accused might influence the proceedings of the probe.Justice Basak also observed that there is no proof yet that the accused were not involved in the crime.Earlier a lower court had allowed bail for the 13 accused.However, the CBI challenged the decision at the bench of Justice Basak, which after a detailed hearing the matter came to a decision that under no circumstances the 13 accused can be released on bail.Distinct pockets in West Bengal were rocked by violence from the day results were announced in May last year where Trinamool Congress bagged a landslide victory.Court cases were filed by the BJP and different individuals at the Calcutta High Court demanding a CBI enquiry in different post- poll violence cases in West Bengal, which involved charges like murder and rape.Teams of the National Human Rights Commission (NHRC) were also sent to West Bengal last year to review the complaints. —IANS

Hyderabad (The Hawk): On Tuesday, the Telangana High Court denied the BJP's request to transfer the TRS MLA poaching matter to the CBI, but it did create an independent Special Investigation Team (SIT) to look into it.
The court also decided that a single judge would oversee the probe into the arrest of three alleged BJP agents for allegedly "luring" four MLAs from the ruling Telangana Rashtra Samithi (TRS) into the BJP.
The SIT, led by Hyderabad Police Commissioner C. V. Anand, was ordered by a division bench under the leadership of Chief Justice Ujwal Bhuyan not to update the state and its leaders on its progress. Only the SIT has been called to appear in court. Additionally, the crew has been told not to release any information to the media.
The court issued the directives in response to the BJP's appeal asking for a CBI investigation.
It requested that the SIT provide a report on the status of the inquiry to the court on November 29.
On the evening of October 26, the Cyberabad police detained Ramachandra Bharati alias Satish Sharma, Simhayaji, and Nandakumar from a farmhouse in Moinabad, close to Hyderabad, where they were allegedly luring four TRS MLAs with promises of significant sums of money.
On the basis of a tip from one of the MLAs, Pilot Rohit Reddy, Cyberabad police carried out the operation. He claimed the defendant made offers of Rs 100 crore to him and Rs 50 crore to the other three.
The Indian Penal Code (IPC) and the Prevention of Corruption Act both contain several sections under which the accused were charged.
The high court ordered the state government and other respondents to file a response to the BJP appeal after staying the ongoing probe into the case on October 29. On November 8, the court lifted the suspension.
On November 9, the state administration established a SIT to look into the situation. It consists of six other police officers and is led by the police commissioner of Hyderabad.
Chief Minister K. Chandrasekhar Rao disclosed evidence in the case, including video recordings of the conversation between the accused and the MLAs, during a news conference on November 3.
Amit Shah, the union home minister, was among the prominent BJP leaders mentioned by the accused.
Parmender Reddy, a senior in the BJP, had petitioned the high court for a CBI investigation because he believed the state government's investigation would not be fair.

New Delhi: In the hit-and-run case where a 20-year-old woman was dragged to death while trapped under a car in the nation's capital, the Delhi Police have invoked Section 302 (murder) of the IPC, a city sessions court was informed on Friday even as it rejected the bail application of one of the accused.
Additional Sessions Judge Susheel Bala Dagar dismissed the bail application of Deepak Khanna after the prosecution said the investigation was at a crucial stage.
Anjali Singh, a scooter rider, was killed on New Year's Day after being struck by a car that dragged her for almost 12 kilometres. Khanna is suspected of being one of the five occupants of the automobile.—Inputs from Agencies
