During our 'kalash yatra', they were prepared with sticks and stones to repeat Karauli-like incident but due to police, it didn't happen," he said.He also talked of retribution. "If they'll harass our daughters, their daughters won't be safe too. I condemn it. The police have arrested the accused. But the opposition parties and a section of the media are trying to give a political twist to the entire event. I have received the news that there was a love affair between the accused and the victim. So why come to a conclusion before the investigation is completed," the chief minister said.However, legal experts have ruled out the logic of a love affair and consensual sex in this case since the victim was a minor. Senior criminal lawyer of the Calcutta High Court, Kaushik Gupta, told IANS that under the Protection of Children from Sexual Offences (POCSO) Act, 2012, even consensual sex is considered rape if it involves a minor girl. "A girl below the age of 18 is minor and law does not identify the right of a minor to give consent for sex. Consensual sex with a minor, as per the law is considered as aggravative penetration for sexual assault," Gupta said. Meanwhile, Banerjee also launched a scathing attack on the media and said that a large section of the media is trying to project the state in a totally negative light. "Even minor events are highlighted nationally by a section of the media holding the ruling party responsible. The same media houses are remaining silent when journalists are stripped in Madhya Pradesh," she said.Public interest litigation was filed in the Calcutta High Court on Monday, demanding a CBI probe into the matter. It is likely to be heard on Tuesday.On Saturday, the parents of the victim filed a complaint at the Hanskhali police station against the accused. The victim's parents alleged that the accused invited the victim to his residence on April 4 to celebrate his birthday. There, as per allegations, the girl was fooled into consuming alcohol and then raped. Later, the victim was dropped at her residence by a woman alleged to be a close associate of the accused.On the night of April 4, the girl started having severe pain in the lower abdomen and died late at night. The victim's family took the assistance of the Child Line and was able to file the FIR at the Hanskhali police station on Saturday. On Sunday, the accused was arrested.—IANS

Nadia (West Bengal): A Central Bureau of Investigation (CBI) team who had arrived in Hanskhali on Thursday visited the residences of the gang rape victim and the accused in the case.CBI DIG Akhilesh Singh with CBI Joint Director Ghanshyam Upadhyay on arriving at the house in Ganrapota Bilpara Village of the prime accused in which the minor girl was allegedly gang raped, found the house to be locked. The lock was then broken after which CBI officials entered the house.Further, the Central Forensic Science Laboratory (CFSL) team collected samples from the alleged crime scene at the residence of the accused.A 14-year-old girl died after she was allegedly gang-raped in Hanskhali in Nadia district earlier this month. The victim's family has accused the son of a Trinamool Congress panchayat leader in the case.Calcutta High Court on Tuesday granted permission to the CBI to investigate the case. In its detailed order, the High Court noted that in order to have a "fair investigation" and instil confidence in the family of the victim, the case was being handed over to the CBI.The state investigating agency was asked to hand over all papers relating to the investigation, as well as the custody of the accused to the central agency. The matter has been listed for May 2.A case under sections 376(2)(G) (gangrape), 302 (murder), 204 (tampering with evidence) of the IPC and relevant sections of the POCSO) Act was registered in the case.Meanwhile, Trinamool Congress (TMC) MP Sougata Roy said the West Bengal government is extremely concerned about crime against women and even a single incident is quite a shame for the party."Everyone is extremely concerned about crime against women. Gurugram: A man was arrested for allegedly raping and blackmailing a woman by using her objectionable pictures and videos here, police said on Tuesday. The 30-year-old woman, who is married, in her complaint alleged that the accused, Yoginder alias Kala, a resident of Loni border in Ghaziabad, sent her a WhatsApp message around a year ago and they later became friends.Around one and half months ago, he asked her to place a video call while she was bathing and made a video clip of it, the woman said in her complaint. He used the video to threaten and rape her on different occasions, police said. The survivor narrated her ordeal to her sister who took her to Badshahpur police station and lodged a complaint against Yoginder, they said. On Monday, he called her to a hotel where police nabbed him, they said. An FIR has been registered against Yoginder under Indian Penal Code (IPC) sections that deal with rape, voyeurism, stalking and criminal intimidation, police said. The accused, who works as a helper at a company in Ghaziabad, confessed to the crime, Station House Officer (SHO) Badshahpur Dinkar Yadav said.“He was not known to the victim but got in touch with her through WhatsApp and later exploited her. We produced him before a city court today which sent him to judicial custody,” the SHO said on Tuesday.—PTI

More details can be collected only after questioning Vijay Babu," the police informed Manorama News."A lookout notice has been issued against him. Prima facie, the case is proved. There is an exploitative angle in this case," Kochi City Police Commissioner Nagaraju Chakilam said.There are procedures to bring the accused back home and that is part of the investigation, he said when asked about the procedures to bring Babu back home."We will take steps, but gradually, not immediately. At present there was no need to take up the matter to Interpol. If necessary, we will do that," the Commissioner said.Vijay Babu's Instagram page had earlier shown that he was in Dubai. However, the police informed that this is not conclusive evidence on his location.The investigation team have been unable trace or contact him after he was booked in the sexual assault case. Officials are hoping to scan airports and other places across the country with the help of the lookout circular.The police will also raid Vijay Babu's flat in Kochi on Thursday, Manorama News reported.The actor is likely to move an anticipatory bail plea in court soon.Babu, had appeared in a Facebook live session and claimed innocence, saying he is the real victim. It seems that he is out of station and absconding now," a senior police officer told PTI.The woman, who appeared in movies produced by Vijay Babu's production house, lodged a complaint with the police on April 22 and detailed through a Facebook post the physical assault and sexual exploitation she had allegedly suffered at the hands of the producer-actor for the past one and half months."He behaved like my saviour for my personal and professional problems but under the guise sexually exploited me," the female actor alleged in the FB post. She further alleged that his modus operandi was trapping her with the role of a "saviour cum friend cum lover" and thereafter intoxicating and sexually abusing her several times in the past one and half months. Besides rape and physical assault, he also forced to consume alcohol and 'happy pill,' a drug. She expressed fear over discussing the assault and exploitation to others because of his clout in the film industry. "I got to know that there are several other women who have been subjected to this trap by Vijay Babu.He has recorded a nude video of mine and threatened me with its consequences and also threatened my life," the victim alleged.However, Babu, in a Facebook live on Tuesday, denied the charges but admitted that he knew the female actor for the past five years. Besides denying the charges, the producer also said he would file a defamation suit against the complainant for tarnishing his image. He mentioned the name of the survivor several times during the FB live saying that he was doing it deliberately as she was not the victim and he was the real victim in the case.—PTI

They allegedly took the victim to an isolated place and committed the crime. On the information given by the locals, police rushed to the scene of the crime and sent the victim for medical examination. The condition of victim, who is admitted to Safdarjung Hospital in Delhi, is critical, they said. The victim's husband, an autorickshaw driver, filed a complaint at DLF Phase 3 police station. "On Monday, I got a desperate call from my wife. She told me she had been stabbed. I asked her about location but she could not tell me a specific area. Then she asked me to reach home. When I reached home, she told me she was raped by two and one of them stabbed her," said the complaint.The victim is not fit for giving statement, police said, adding that on the basis of her husband's complaint, an FIR was registered against two persons under IPC sections 376 (rape), 506 (criminal intimidation), 324 (grievously hurt), and 34 (common intention) on Tuesday.Police said they have nabbed one of the accused, Anil Thakur, a native of Bihar, and the probe is underway."We have arrested one of the accused and are interrogating him," Gurugram Police Commissioner Kala Ramachandran told—PTI

Lucknow: A 13-year-old girl who was allegedly raped by four men over three days was sexually assaulted again by the station house officer of a police station where she had been left by her attackers, the police said on Wednesday.Five people have been arrested and an FIR filed against six, including the teen's aunt and the SHO of the Pali police station who is absconding. Besides, all the other policemen of the station have been taken away from active duty and sent to police lines.Deputy inspector general, Jhansi Jogendra Kumar has been asked to probe the matter and submit the report within 24 hours, officials said.As chilling details of the case came to light, the opposition Samajwadi Party and Congress highlighted the vulnerability of women and asked where they should go to file their complaint and whom should they trust.According to the mother of the multiple-rape survivor, her daughter was taken to Bhopal, about 240 km from Lalitpur, on April 22 by four men and raped there for three days.The men left the girl at the Pali police station, where she was again sexually attacked, she alleged.The girl narrated her ordeal during counselling at an NGO, which approached the superintendent of police.Following his intervention, an FIR was registered on Tuesday. Hazaribag:&nbsp;A teenaged girl was raped and murdered after she was allegedly kidnapped by two men from Matwari Bhuiyan Toli in Hazaribag district, a senior police officer said on Saturday.The incident took place on Friday and the duo, who were aged 20 and 22 years, were arrested after the girl's body was found near a pond in Pakhi on Saturday morning, he said.Two lawyers of Hazaribagh court spotted the body and raised the alarm and informed the police.The two were arrested on the basis of the complaint filed with the police by her family, district superintendent of police, Manoj Ratan Chothe said.The accused, he said, had kidnapped the girl who was working as a maid when she was returning home from work.Her parents, however, did not inform the police about her abduction till her body was found.The two tormentors, who hail from same locality as the girl, were arrested on the basis of FIR lodged by her father, who claimed that they were known to his daughter and that one of them was in a relationship with her.The duo were arrested after the complaint against them was lodged by the victim's family.They confessed that they had killed the girl with a sharp weapon after raping her. The two also confessed that they had dumped the girl's body in the pond on Friday to hide any evidence and fled the area, the SP said.They were produced before the Hazaribagh chief judicial magistrate court, which sent them to jail custody—PTI

Jaipur: A 23-year-old woman from Jaipur has alleged that Rohit Joshi, the son of Rajasthan Minister Mahesh Joshi, raped her on multiple occasions over a year, following which the Delhi police has registered a zero FIR, officials said on Sunday.A senior Delhi police officer said the Rajasthan Police has been intimated about the FIR and will further investigate the matter.The case was registered on May 8 at a police station in North District under sections 376 (rape), 328 (causing hurt by means of poison, etc., with intent to commit an offence), 312 (causing miscarriage), 366 (kidnapping, abducting or inducing woman to compel her mar­riage, etc), 377 (unnatural offences) and 506 (criminal intimidation) of the Indian Penal Code, the police said.Mahesh Joshi, the Minister for Public Health Engineering, could not be reached over phone for his reaction.In her complaint, the woman alleged that the minister's son raped her on several occasions between January 8 last year and April 17 this year and also promised to marry her.The woman said she developed friendship with Rohit Joshi on Facebook last year and since then they have been in contact. The two met in Jaipur first and he allegedly invited her to Sawai Madhopur on January 8, 2021.During their first meeting, she alleged, he spiked her drink and took advantage of it. When she woke up the next morning, he showed her naked photographs and videos which worried her, reads the FIR.Mentioning about another meeting, she alleged that Rohit Joshi had also once met her in Delhi and forced himself upon her."Rohit made me stay at a hotel where he got our names registered as husband and wife. He then promised to marry me...but then he got drunk and abused me...He would beat me up and make obscene videos of me. He would threaten to upload them and make them viral...," the woman alleged.She further stated that on August 11, 2021, she found out that she was pregnant with his baby and alleged that he forced her up take a pill but she didn't, the complainant stated.According to the woman, the accused allegedly raped her on several occasions."Based on the complaint of the woman, we have registered a zero FIR. According to the FIR, about 10 years ago she met the Sahitya Akademi award-winning writer on a social media platform and become friends.In her complaint, she referred to an incident when he allegedly hurled abuses and beat her up following her eye surgery."In 2013 she went for an eye treatment to AIIMS and she got late while returning home, for which he hurled abuses and beat her up. I started crying but he raped me. The next day, he came and started apologising. He also promised to marry me," the FIR stated. The woman claimed further said that to avoid police action, he kept on promising to marry her but last year she discovered from his mobile that the accused had relations with several other girls to whom also he had promised marriage.The FIR also states that a police officer had called up the woman's father and told him that she (the woman) is blackmailing the writer to extort money from him. —ANI

Bijnor: The police have arrested two boys for the gang-rape of a 16-year-old girl who consumed poison along with her male friend.The girl and the boy were taken to a district hospital, where the boy died on Sunday and the girl is still critical.The father of the girl has lodged a complaint against the boys since he had seen them together on Saturday night.Bijnor Superintendent of Police (SP) Dharamveer Singh, said on Monday, "An investigation in the case is still on and we have arrested two other boys named by the girl's father in his complaint. A case has been registered against three persons, including the girl's friend, under Sections 376D and 328 of the IPC, as well as under Section 5/6 of the POCSO Act."The girl and the accused were neighbours and belonged to the same community. The father of the girl alleged that his daughter was caught by the three accused and was gang-raped, which is why she consumed poison.Bijnor SP said, "Prima facie it seems that the boy had a love affair with the girl for the past few months. They were spotted together on Saturday night. The girl's father approached the police after the two consumed poison."The family of the accused, meanwhile, said, "The two were in a relationship. The girl had called the boy to her house but when they were caught by her father, they consumed poison." The police said all the accused are minors. —IANS

Datia:&nbsp;A nine-year-old girl was allegedly raped and murdered by a distant relative during a marriage function in Madhya Pradesh's Datia district, a senior police official said on Tuesday.The crime took place in Tiletha village on the intervening night of Sunday and Monday and the 24-year-old accused was later arrested, Superintendent of Police Aman Singh Rathore told reporters.Some villagers informed personnel at the Goraghat police station on Monday morning that the body of a girl was lying in shrubs near a canal in the village, he said.On an inspection of the spot, it was found that the girl was allegedly raped and murdered, the official said.During the course of investigation into the case, another minor told the police that a male relative of her initially tried to take her away while she was sleeping on a cot with the victim at the marriage function, but she ran away to her mother who was attending the wedding functions, he said.Later, when that girl returned, she found the victim missing, he said.The man, who was also a distant relative of the victim, was subsequently arrested.The accused told the police that he took the victim, who was sleeping, behind the house and raped her, the official said.The accused also told the police that he later killed the victim to hide the crime, Rathore said.A case was registered against the accused under relevant sections of the Indian Penal Code and the Protection of Children from Sexual Offences (POCSO) Act, he said.—PTI

New Delhi: The Delhi high court on Wednesday delivered a split verdict on the issue of criminalisation of marital rape, with one of the judges favouring striking down the provision and the other holding it was not unconstitutional.The division bench granted leave to the parties to file an appeal before the Supreme Court.While Justice Rajiv Shakdher, who headed the division bench, favoured striking down the marital rape exception, Justice C Hari Shankar said the exception under the IPC is not unconstitutional and was based on an intelligible differentia.The petitioners had challenged the constitutionality of the marital rape exception under Section 375 IPC (rape) on the ground that it discriminated against married women who are sexually assaulted by their husbands.Under the exception given in Section 375 of the IPC, sexual intercourse or sexual acts by a man with his wife, the wife not being minor, is not rape.Delivering the verdict, Justice Shakdher said, "As far as I am concerned, the impugned provisions -- exception 2 to section 375 and section 376 (E)... are violative of Articles 14, 15, 19(1) (A) and 21 of the Constitution and are hence struck down."He said this declaration will operate from the date of its pronouncement.However, Justice Shankar said, "I have not been able to agree with my learned brother" and added that these provisions do not violate Articles 14, 19 (1) (A), and 21 of the Constitution.He said the courts cannot substitute their subjective value judgement for the view of the democratically elected legislature and the exception is based on an intelligible differentia.He said the challenge to the provisions by the petitioners cannot sustain.In February, the Centre had urged the court to grant more time to enable it to state its stand on the issue after a consultative process.The request was however turned down by the bench on the ground that it was not possible to defer an ongoing matter endlessly.In its 2017 affidavit, the Centre had opposed the pleas, saying that marital rape cannot be made a criminal offence as it could become a phenomenon that may destabilise the institution of marriage and an easy tool for harassing husbands.—PTI

New Delhi: The voice of the legislature is the voice of people and if the petitioners feel a husband forcing his wife for sex against her will should amount to rape, they should approach Parliament, Justice C Hari Shankar of the Delhi High Court said on Wednesday.He refused to hold as unconstitutional the exception in law which grants protection to husbands from being prosecuted for non-consensual sexual intercourse with their wives.He said the court cannot label, as particular offences, the acts that the legislature has consciously not chosen to so label.“Where, in so choosing, the legislature has not acted in derogation of the Constitution, we have to step back. Any further foray, by us, into this disputed realm, would partake of the character of judicial legislation, which is completely proscribed by law,” Justice Shankar said in his 200-page judgement.The issue of criminalisation of marital rape witnessed a split verdict from a division bench of the high court with one of the judges favouring striking down the exception in law which grants protection to husbands from being prosecuted for non-consensual sexual intercourse with their wives, the other refused to hold it as unconstitutional.However, both the judges on the bench concurred with each other for granting the certificate of leave to appeal to the Supreme Court in the matter as it involves substantial questions of law that requires a decision from the top court.While Justice Rajiv Shakdher, who headed the bench, favoured striking down the marital rape exception and said it would be tragic if a married woman's call for justice is not heard even after 162 years since the enactment of the Indian Penal Code, Justice Shankar said the exception under the rape law is not unconstitutional and was based on an intelligible differentia having a rational nexus with the object of the exception as well as section 375 (offence of rape) of the Indian Penal Code (IPC) itself.The petitioners had challenged the constitutionality of the marital rape exception under section 375 of the IPC on the ground that it discriminated against married women who are sexually assaulted by their husbands.Under the exception given in section 375 of the IPC, sexual intercourse or sexual acts by a man with his wife, the wife not being minor, is not rape.In his verdict, Justice Shankar said, “If, therefore, the petitioners feel that the act of a husband compelling, or even forcing, his wife to have sex with him, against her will or consent, should amount to ‘rape', and should attract section 375, or that the other applicable provisions in civil and criminal law are insufficient to deal with such a situation, they would have to take up the issue in Parliament, not in court.” He said should the legislature be convinced of their case, the petitioners' grievances may well be met.“The Parliament is empowered to legislate and frame a new law for the said purpose. Equally, the Parliament may also deem it appropriate to do away with the impugned exception. We, however, cannot do so, unless the impugned exception is constitutionally vulnerable. That, in my considered opinion, it is not,” Justice Shankar said.He said given the nature of the marital institution in the socio-legal milieu of the country, if the legislature is of the view that for preservation of the marital institution, the exception should be retained, then the court would not be in a position to strike down the exception unless it were to hold per contra, that the view of the legislature is incorrect.“That, however, we cannot do, as it would amount to substituting our value judgement for the value judgement of the legislature, which, in a democracy, is unquestionably entitled to precedential preference, as the voice of the legislature is, classically and constitutionally, the voice of the people,” Justice Shankar said.He said the court cannot substitute its view for that of the legislature and hold definitively that treating non-consensual sex by a husband with his wife would not imperil or threaten the marital institution.“Neither do we have the wherewithal, or the resources, to undertake an incursive study into the issue, nor, for that matter, can we legitimately do so. The consideration and the concern of the legislature are legitimate. The legislation must, ergo, be upheld,” he noted.He also said the legislature, at its command, has the vast arsenal of State resources and the legislation is not an overnight exercise, least of all when it involves the decision to define an act as an offence."If, therefore, the legislature, after interaction with stakeholders and after conscious deliberation and debate, forms the opinion that introduction of the concept of ‘rape' into the marital sphere may imperil the institution of marriage, this court, at the instance of arguments of counsel, howsoever gifted, would, in my opinion, be thoroughly ill-equipped to hold otherwise," he said.The court's verdict came on PILs filed by NGOs RIT Foundation, All India Democratic Women's Association, a man and a woman seeking striking down of the exception granted to husbands under the Indian rape law.NGO, Men Welfare Trust (MWT) had argued before the high court that sexual intercourse between a husband and wife cannot be treated at par with that in non-marital relationships as the issue of consent cannot be divorced from the context of a marriage.—PTI

Ranchi: &nbsp;A 15-year-old girl was allegedly kidnapped and raped by five men in a car in Ranchi, police said on Friday.The girl told the police that she was forced into the car from the Ring Road in Dhurwa by the accused on Wednesday night, they said.A patrol team of the police found the car on the roadside near a restaurant in Daladali in Ratu police station area, Superintendent of Police (Ranchi-Rural) Naushad Alam told PTI.Suspecting something was amiss, the personnel went to check the car and found the girl, who was crying, along with five men, he said.The five accused, all in their 20s, have been arrested, he said.The girl was sent home after a medical examination, police said.Further investigation into the incident is underway, they said.—PTI
