New Delhi: The Supreme Court on Monday declined to urgently list a plea against the practice of Talaq-e-Hasan, under which a man can divorce his wife by pronouncing “talaq” once a month for three months, and all other forms of unilateral extra-judicial talaq. Senior advocate Pinky Anand, representing a Muslim woman, mentioned the matter before a vacation bench of Justices Ajay Rastogi and B.V. Nagarathna. As she submitted that two notices have already been sent to her client and sought urgent hearing in the matter, the bench asked the senior counsel to mention the matter before the court’s mentioning registrar. Anand contended that the petition was filed at the beginning of this month and her client has been twice granted notices of divorce. “The lady is with a child. The first notice was given on April 19 and the second notice was issued on May 19,” she said.At this, the bench said: “Make a request to the registrar and if he does not listen then come to us. Last week, Anand had mentioned the matter before a vacation bench headed by Justice D.Y. Chandrachud. The plea, filed through advocate Ashwani Kumar Dubey, sought a direction to declare “Talaq-e-Hasan and all other forms of unilateral extra-judicial talaq”, unconstitutional for being arbitrary, irrational, and violative of Articles 14, 15, 21, 25 of the Constitution. The plea also sought a direction to the Centre to frame guidelines for neutral uniform grounds of divorce and uniform procedure of divorce for all citizens. The petitioner, who claimed to be a victim of “unilateral extra-judicial Talaq-e-Hasan”, also submitted a complaint to the Delhi Commission for Women in February this year and also lodged an FIR in April, but claimed that the police told her that Unilateral Extra Judicial Talaq-e-Hasan is permitted under Sharia.The plea said: “The Muslim Personal Law (Shariat) Application Act, 1937, by providing for the application of Muslim personal law in matters relating to marriage where the parties are Muslims, conveys a wrong impression that the law sanctions Talaq-e-Hasan and all other forms of unilateral extra-judicial talaq, which is grossly injurious to the fundamental rights of married Muslim women and offends Articles 14, 15, 21 and 25 of the Constitution of India and the international conventions on civil and human rights.” The plea contended that the Constitution neither grants any absolute protection to the personal law of any community, nor exempts personal laws from the jurisdiction of the legislature or the judiciary.The plea argued that the practice of Talaq-e-Hasan and other forms of unilateral extra-judicial talaq is neither harmonious with the modern principles of human rights and gender equality, nor an integral part of Islamic faith. “Many Islamic nations have restricted such practice, while it continues to vex the Indian society in general and Muslim women like the petitioner in particular. It is submitted that the practice also wreaks havoc to lives of many women and their children, especially those belonging to the weaker economic sections of the society,” it added.—IANS

Divorce is one of the biggest epidemics in our current society that isn't being recognized or treated as such. As a marriage and family therapist, of course, divorce is something that I am passionate about because it is something that I am spending my life fighting against. I am not ignorant enough to believe that I will see all cases of divorce end during my lifetime, nor am I ignorant enough to believe that all divorce cases even should be prevented. I am, however, perhaps ignorant in my belief that it is crazy for people considering divorce to get advice from a divorce attorney.
Now, most of you are thinking I'm crazy. Who would go to a divorce attorney for advice about their failing marriage? Many people, unfortunately. I had no idea until I began working with marriages and families in crisis just how many individuals and even couples were seeking refuge and advice from their divorce lawyer.
I was overwhelmed by my new knowledge for one primary reason. Have people who considered getting a divorce forgotten that a divorce attorney is a very last person who will be concerned with them repairing a broken marriage? A divorce attorney makes a living helping married people get divorced while getting as many benefits from the divorce as possible. So why would any nearly-divorced person go to a divorce attorney in hopes of fixing their marriage? beats me.
My advice to anyone struggling in their marriage is to make an appointment to visit a professional counsellor or a marriage and family, therapist. The core reason why I suggest this is because in general, counsellors and therapists are people who deeply want to see marriages and families restored rather than torn apart. If I am looking for someone to help me fix my car, then it is far wiser to get help from an individual who believes that cars can be fixed, right? Of course, the same is true with marriage. Do not seek help from someone who believes that marriages should end easily and for any reason at all. Go instead to a professional who is trained in giving you wisdom about making your relationship work.
A divorce lawyer is great for people who are sure that divorce is the option they are choosing. If you are still unsure of your options and are still hoping for healing in your marriage, then a divorce attorney is the last person you should see.

For the interest of society, the marriage or the marital relationship needs to be surrounded by every safeguard for the cause specified by law. Lucknow: It is the season of discord and divorce in political families in Uttar Pradesh.
After UP minister Daya Shankar Singh and his wife and former minister Swati Singh called it quits and got a divorce, ending their 22-year-old marriage, it is now the dispute between former minister and UP MLA Raghuraj Pratap Singh a.k.a. Raja Bhaiya, and his wife Bhanvi Singh that is making news.
Raja Bhaiya has filed for divorce in the family court in Saket, Delhi. His plea to end his 28-year-old marriage is now listed for hearing on May 23.
The hearing was adjourned on Monday as family court judge Shunali Gupta was on leave.
The counsel for Bhanvi Singh also sought time to file a reply. Differences between Raja Bhaiya and his wife Bhanvi Singh started surfacing when she filed an FIR for fraud against Raja Bhaiya's close aide Akshay Pratap Singh, an MLC, in February this year in Delhi. Bhanvi claimed in her FIR that Akshay fraudulently got his associate appointed as a director in the firm owned by her. She claimed that they wanted to usurp her company. Bhanvi said they forged her signature and made fake documents to appoint the director. However, Raja Bhaiya later told reporters that Akshay had not done anything wrong and he was with him. People close to Raja Bhaiya claim that Bhanvi has been living in Delhi for the past three years - an indication that things were not well between the couple.
Sources confirmed that there were several efforts by family members and friends to make the couple sort out their differences but in vain.
Raja Bhaiya and Bhanvi Singh got married in February 1995, two years after he entered active politics. According to sources, in his divorce plea, Raja Bhaiya has stated that his wife not only left home but also refused to reside with him. It says that Bhanvi made false allegations against Akshay and caused discord among family members that amounted to mental and emotional cruelty towards him.
Raja Bhaiya and Bhanvi have four children - two daughters and twin sons. Eldest daughter Raghvi was born in 1996. The second daughter, Brijeshwari, was born in 1997. Raghvi is a reputed shooter. The twin son - Shivraj and Brijraj - were born in 2003.
In active politics since 1993, Raja Bhaiya is an MLA for the 7th consecutive term from Kunda.
His clout in UP politics extends beyond his home district Pratapgarh. He has served as minister in Kalyan Singh, Ram Prakash Gupta, Rajnath Singh, Mulayam Singh and Akhilesh Yadav governments.
He now heads his own Jansatta Dal.&nbsp;&nbsp;

Prayagraj (UP): The Allahabad High Court, hearing an appeal by a man against the dismissal of his divorce petition by a family court, on Thursday observed that denying sex to a spouse for a long time without sufficient reason amounts to mental cruelty.

The high court said that it was evident from the record that, since long, the parties to the marriage had been living separately, and the wife had denied discharging the obligation of marital liability.

The couple had got married in 1979. After seven years, the wife's 'gauna' ceremony was performed and they started living as a couple.

According to the petitioner, his wife refused to fulfil her obligation of marital life and then she left for her parents' home.

The husband claimed that he made several attempts to convince her but the woman did not establish any physical relationship with him. The man was serving in the police department and had to reside at the place of his posting.

In July 1994, the couple got mutually separated before a panchayat after the man paid alimony of Rs 22,000 to his wife. She later married another man.

Then the husband approached a court seeking divorce on grounds of mental cruelty and desertion. However, the trial court refused to grant divorce on the grounds of cruelty.

Feeling aggrieved, he filed an appeal before the Allahabad High Court against the order of the family court which dismissed his divorce plea.

A bench of Justice Suneet Kumar and Justice Rajendra Kumar-IV, while granting the husband a decree of divorce, on Thursday said: "Undoubtedly, not allowing a spouse for a long time to have sexual intercourse with his or her partner, without sufficient reason, itself amounts to mental cruelty. Since there is no acceptable view in which a spouse can be compelled to resume life with the consort, nothing is given by trying to keep the parties tied forever to a marriage."

Terming the approach taken by the family court "hyper-technical", the bench said: "It is evident from the record that since long, the parties to the marriage have been living separately, according to plaintiff-appellant, defendant-respondent had no respect for marital bond, denied discharging obligation of marital liability. There has been a complete breakdown of their marriage." IANS

New Delhi: The Delhi High Court on Thursday ordered former Jammu and Kashmir Chief Minister Omar Abdullah to provide a monthly maintenance of Rs 1.5 lakh to his estranged wife, Payal Abdullah.  The order was delivered by Justice Subramonium Prasad, who also directed a monthly pay of Rs 60,000 to their son's education.  The case stems from a plea filed by Payal in July 2018, wherein she contested a trial court order from April 26, 2018.
The trial court had granted interim maintenance of Rs 75,000 per month to Payal Abdullah and Rs 25,000 for their son until he reaches the age of 18.  Seeking an enhancement of the maintenance allowance, Payal approached the high court, asserting that the awarded sum was inadequately low.  She had said that their sons Zahir and Zamir are not yet of an age to manage their own expenses and are reliant on their parents for education and daily expenditures.  Moreover, she had argued that the overall interim maintenance awarded is too less to take care of the whole family.  In a separate case, a trial court in 2016 had dismissed Omar Abdullah's request for a divorce, concluding that he had not substantiated the irretrievable breakdown of the marriage and his allegations of cruelty or desertion.

The Jonas Brothers singer, 34, has been on tour with his brothers over the last few weeks amid news of his divorce from the ‘Game of Thrones’ actress, reports ‘Female First UK’.
At his show at Dodger Stadium, Los Angeles, he told fans before he launched into a rendition of ‘Hesitate’: “Thank you everyone for the love and support to me and my family – I love you guys.”
He walked around the stage and looked down at the ground while the crowd cheered him on, and video from one cinematographer showed him in close-up singing the lyrics to the song while a single tear rolled from his eye. During the moment Joe was singing the lines: “Time, time only heals if we work through it now, I promise we’ll figure this out.”
As per ‘Female First UK’, Joe continued to sing the chorus along with brothers Nick and Kevin despite being overcome with emotion.
His parents Denise and Kevin Jonas Sr were watching in the audience and a clip showed Denise putting her hand over her mouth and shook her head as soon as her children began playing the song. Joe also told fans at the Saturday gig: “It’s been a crazy week I just wanna say, look – if you don’t hear it from these lips, don’t believe it. OK?”
He filed for divorce from Sophie, with whom he has daughter Willa, three, as well as another girl born last year, on 5 September after four years of marriage and two daughters.
The couple said in a joint statement at the time, obtained by ‘Female First UK’, “After four wonderful years of marriage we have mutually decided to amicably end our marriage.
“There are many speculative narratives as to why but, truly this is a united decision and we sincerely hope that everyone can respect our wishes for privacy for us and our children.”
Sources told Page Six Joe has been “unhappy” for a while in his marriage to Sophie. One added: “Divorce was a last resort for Joe. He never wanted to break up his family, but he had to take what he felt was the best course of action for his girls. The former couple who have not revealed the name of their second daughter – eloped in Las Vegas in May 2019 and said “I do” again at a more glamorous wedding in France later that year.

Los Angeles: Singer-songwriter Sia has revealed that she went through a period of depression following her divorce from Erik Anders Lang after two years of marriage.
"Well, actually, the truth is that I had just been every now and again writing a song here or there for the last six, seven years," said the songwriter while discussing her forthcoming album ‘Reasonable Woman’, reports People magazine.
Sia spoke with Zane Lowe on Apple Music 1 saying, "I got divorced and that really threw me for a loop. That was such a dark time that I was in bed for three years, really, really severely depressed. And so I couldn't really do anything for that period of time."
The ‘Reasonable Woman’ will mark the Grammy winner's first album release since 2016's ‘This Is Acting’. While the album is expected to be released in spring 2024, the singer dropped a single from the album titled ‘Gimme Love’ on Wednesday.
Speaking about how she was able to get herself to record the new music, Sia said she started by recording "just little bits and pieces here and there”.
"And then, finally, it just turned out we had enough songs to make an album, enough good ones," she explained, quoted by People.
"So I just rely on my management to tell me when we've got enough good ones because I don't really... I can tell when I think one is particularly good, I think I can tell, but they tell me when we've got 11 or 12 or 13 enough good ones, real good ones."
Although the performer has been relatively private about her love life following her divorce, she wed boyfriend Dan Bernad, in an intimate ceremony in Portofino, Italy, in May, this year.

Thiruvananthapuram: The Kerala High Court has intervened and decided to dissolve a marriage that was on the rocks for the past 38 years.
The court pointed out that retaining a marriage that has irretrievably broken down would amount to cruelty to both parties, and no meaningful purpose would be served by the same and rode on an apex court judgment which said keeping parties together despite irretrievable breakdown of marriage amounts to cruelty on both sides.
The court came to the conclusion when an elderly appellant, who is the husband of the respondent, filed the present appeal on being aggrieved by the dismissal of the plea for divorce on the ground of cruelty by a family court.
The beleaguered man claimed that the marriage had irretrievably broken down and the refusal to issue consent for mutual separation ought to be treated as cruelty.
He also emphasized that he had been neglected by his wife and two children, and that he had not even been invited to the wedding of his son.
The respondent, however, denied the allegations levelled against her, and submitted that minor bickering in the marriage could not be treated as cruelty.
The Family Court found the allegations as not constituting any mental or physical cruelty to grant a decree of divorce, and dismissed the plea.
However, the high court noted that the marriage, now 38 years old, could not be revived.
It also took note that the appellant wasliving alone.
Finally, the Court relying upon the Supreme Court went forward and said, "retaining the marriage itself is a cruelty to both the parties and no meaningful purpose would be served," opined the court and allowed the appeal and dissolved the marriage between the parties.

New Delhi: Setting aside a family court's order, the Delhi High Court has pointed out the importance of a liberal approach by such courts in handling family disputes. Justice Navin Chawla, while hearing a case where a wife's right to file her written statement in divorce proceedings was denied, said that the stringent standards applicable to commercial disputes should not be rigidly applied in family matters.
The case in question involved a situation where the family court had closed the wife's right to submit her written statement in divorce proceedings. Justice Chawla said that such a decision could have serious personal consequences for the concerned party and that the family court's approach should align with the objectives of family law, rather than technical legalities.
The court also noted that if the family court determines that one party is intentionally causing delays in the proceedings, it should issue orders specifying conditions to prevent further delays. In this particular case, the wife had challenged the family court's decision to strike off her defence, which was made in response to her husband's divorce petition filed in Uttar Pradesh.
However, the Supreme Court had transferred the case to Delhi based on a petition by the wife. The wife had sought an adjournment in the family court, citing illness as the reason for not filing her written statement. Nevertheless, the family court rejected her request for an extension of time to submit the written statement. Justice Chawla took into account the unique circumstances of the case, including the fact that notice had been issued to the parties to appear after the transfer of the divorce petition. Furthermore, a thirty-day period had been granted to the wife to file her written statement.
The court said that in family disputes, family courts should adopt a more lenient approach compared to the strict standards applied in commercial disputes. Hence, Justice Chawla set aside the previous order and allowed the wife to file her written statement before the family court with a clear stipulation that failure to do so would result in the closing of her right to file the statement, allowing the family court to proceed with the divorce petition accordingly.

Washington [US]: American singer-songwriter and actor Joe Jonas and 'Game of Thrones' star Sophie Turner are using mediation to settle their dispute over child custody, reported People. Lawyers for the estranged couple announced in a hearing on Tuesday that they starting a four-day mediation on Wednesday to settle difficulties in their divorce, including establishing custody and a parenting plan for their two children, Willa, 3, and Delphine, 14 months.
Although Judge Katherine Polk Failla set a Jan. 2 trial date, the mediation aims to solve many of Turner, 27, and Jonas' custody issues. In court, Turner's lawyer Stephen Cullen claimed that Jonas, 34, is asking for joint custody, saying that "what he was looking for is a 50-50," reported People. "The parties are both seeing their children, which is what we all want," Cullen later said. Judge Failla agreed with Cullen, saying that she "echo[es] concerns about the children" that he had brought up. Despite high hopes for the mediation, Cullen said that the current case "should proceed in parallel track to [the] mediation." Reps for Jonas and Turner did not immediately respond to People's request for comment regarding the mediation.
According to People, the mediation comes after Turner sued her estranged husband for wrongful retention, alleging that Jonas was withholding their passports and not allowing them to return to England. The complaint against the musician called for "the immediate return of children wrongfully removed or wrongfully retained," with Turner's legal team asserting the "wrongful retention" began on September 20. Shortly after Turner filed her complaint, Jonas issued a statement refuting her claims and claiming that the two had agreed to collaborate on a co-parenting plan. "After multiple conversations with Sophie, Joe initiated divorce proceedings in Florida, as Florida is the appropriate jurisdiction for the case," the statement read. "Sophie was aware that Joe was going to file for divorce. The Florida Court has already entered an order that restricts both parents from relocating the children. Sophie was served with this order on September 6, 2023, more than two weeks ago." "Joe and Sophie had a cordial meeting this past Sunday in New York when Sophie came to New York to be with the kids. They have been with her since that meeting. Joe's impression of the meeting was that they had reached an understanding that they would work together towards an amicable co-parenting setup." The statement also alleged that less than 24 hours after the "amicable co-parenting setup" was agreed upon, "Sophie advised that she wanted to take the children permanently to the UK. Thereafter, she demanded via this filing that Joe hand over the children's passports so that she could take them out of the country immediately." A few days later, the pair reached a temporary agreement to keep their two daughters in New York City, according to documents filed in New York and obtained by People. The interim consent order states that Turner and Jonas were ordered to keep their kids in the Southern and Eastern districts of New York, which includes New York City, Long Island and the Hudson Valley, reported People.

New Delhi: The Delhi High Court has observed that a spouse who has a reasonable capacity to earn but chooses to remain unemployed and idle without sufficient explanation should not be permitted to saddle the other partner with the one-sided responsibility of meeting expenses by providing maintenance.
The high court made the observation while reducing the amount of monthly maintenance from Rs 30,000 to Rs 21,000 to be paid by a man to his estranged wife under the Hindu Marriage Act (HMA).  It said the woman claimed to have no independent source of income but has a reasonable educational background being a graduate from Delhi University.
“She appears to have voluntarily undertaken social work as claimed despite there being no impediment to undertaking meaningful employment. The spouse having a reasonable capacity of earning but who chooses to remain unemployed and idle without any sufficient explanation or indicating sincere efforts to gain employment should not be permitted to saddle the other party with one-sided responsibility of meeting out the expenses,” a bench of justices V Kameswar Rao and Anoop Kumar Mendiratta said.  The bench said the maintenance does not have to be provided with mathematical precision but to give relief to the spouse who is unable to maintain and support during the pendency of proceedings and to ensure that the party should not suffer due to paucity of source of income.  It said the provision for maintenance under the HMA is gender neutral and sections 24 and 25 of the Act provide for the rights, liabilities and obligations arising from marriage between the parties.  The high court was hearing an appeal by the man challenging a trial court’s order directing him to pay Rs 30,000 monthly maintenance to his estranged wife and litigation expenses of Rs 51,000.  He said earlier the trial court had asked him to pay Rs 21,000 monthly to the woman but it was later enhanced to Rs 30,000 without any change in circumstances.  The man said he was getting Rs 47,000 in-hand salary and had to support his family and it would not be possible for him to pay Rs 30,000 per month.  The man claimed that the woman was working in a hospital here and was earning Rs 25,000 monthly.  The woman, however, said she was merely working as a social worker and was not drawing any salary from the hospital.  The couple got married in 2018 but the woman returned to her parental home in July 2020 owing to differences between them.  The high court noted that the net salary received by the man after deductions and recoveries is Rs 56,492 and there was nothing on record to infer that deductions as per the pay slip had been initiated by him only after the commencement of litigation between the parties to escape maintenance.  “In the facts and circumstances, while considering the quantum of maintenance, the liabilities of the appellant (man) along with his duties towards other family members cannot be ignored,” it said.  The high court said maintenance of Rs 21,000 per month to the woman till disposal of the petition before the trial court would be reasonable and it shall be paid along with litigation expenses or arrears in terms of the family court’s order.  Considering the inflation and rising prices, the maintenance during the pendency of divorce proceedings shall be enhanced by Rs 1,500 per month for each succeeding year till the disposal of the plea, it said.

An eyewitness also told The Sun that they saw the two at the Gare du Nord railway station "chatting and laughing a lot."  Sophie married Joe in 2019 before he filed for divorce in early September. They share two children together, daughters Willa, 3, and D.J., 16 months. In October, the estranged couple reached a custody agreement for their children.

New Delhi [India]: The Delhi High Court on Tuesday dismissed the plea filed by former Jammu and Kashmir's Chief Minister Omar Abdullah against a family court order denying him a divorce from his wife Payal Abdullah. Delhi's Patiala House Court on August 30, 2016 dismissed his petition seeking divorce on the grounds of cruelty. He filed the plea in 2013.
They got married In September 1994 but have been living apart since 2009. The couple has two sons. The division bench, comprising justices Sanjeev Sachdeva and Vikas Mahajan, upheld the family court order and dismissed the appeal challenging it. While dismissing the appeal, the division bench said it found no infirmity in the family court order denying divorce to him. The high court also said the allegations of cruelty by Omar Abdullah against Payal are vague. The bench noted further that the appellant failed to prove any act of cruelty, whether physical or mental, by Payal Abdullah.  The high court dismissed the appeal, finding it without merit. The family court had dismissed his petition, stating that he failed to prove the claims of cruelty or desertion.
